CA: State warns of voided votes

SAN FRANCISCO -- Halting the Oct. 7 recall election would negate the votes of nearly 400,000 Californians and waste millions of dollars already spent, state and local elections officials told the 9th U.S. Circuit Court of Appeals on Wednesday.

California Secretary of State Kevin Shelley, joined by county registrars of voters in Los Angeles and Sacramento, urged the court to reconsider a decision by a three-judge panel that would put the election off until March.

The ACLU sought to delay the scheduled Oct. 7 election because, it said, error-prone punch-card voting machines would be used in six counties -- including Sacramento and Los Angeles -- that together account for 44 percent of the state's registered voters.

The same voting machines that recently re-elected Davis (and elected the legislature), with absolutely no contest of the elections by anyone...give me a break.

Here are the words of Joseph Farah which I wholeheartedly agree:

"If President Bush doesn't speak out strongly against the federal judges who arrived at this ludicrous decision and urge Congress to rein in the 9th Circus, he's a coward. If Congress doesn't act now to curtail judicial tyranny – both in the 9th Circus and in the Supreme Circus – the rule of law and the will of the people will mean nothing in America any longer."

I'm sick of moral cowards. If Bush doesn't have the guts to fight, then VOTE HIM OUT and get someone in the oval office who will stand up for the Constitution and the rule of law!

Oh please you havea decision of a federal appeals court in a state election that has nothing to do with Bush and you turn it into an anti- Bush issue? The courts are an independent branch of government. The only body taht can control the 9th Circuit is the US Supreme Court. Finally, the president would demean himself by complaining about 9th Circuit opinions. Anyone who wants the executive to "rein in" the judiciary doesn't understand our system of government.

And I'll tell you something else, even though the 9th Circuit is especially out there, this decision is not far different from ludicrous actions taken by federal courts every day throughout the U.S. The American people have no idea the degree to which the federal courts, often relying on Acts of Congress, meddle in their lives.

Then you don't understand the law or the Constitution or the implications of an out-of-control judiciary. The 9th is a FEDERAL COURT. Get it? Bush and the do-nothing Congress had better start reigning in the oligarchs in black robes or you will be living in a dictatorship in the near future. Any pol who won't stand up for the CONSTITUTION is worthless. I won't waste my vote on anyone who doesn't honor his oath to the U.S. Constitution, and THERE ARE DAMN FEW who do! Bush gave his approval to that abomination of a ruling in Michigan on racial quotas - apparently Bush doesn't mind that it is a racist decision that rejects equal justice under the law. I also didn't see Bush say anything about the Lawrence decision from his home state (more judicial tyranny) or the 10 commandments decision in Alabama. Republicans are cowards - as is clearly seen in their spineless response to the dem. filibuster in the Senate. I'm sick of cowards and sick of lip service. If you want to waste your vote, go right ahead. BUT I WILL USE ALL OF MY INFLUENCE TO PERSUADE PEOPLE TO ABANDON BOTH OF THE CORRUPT POLITICAL PARTIES RUNNING THIS COUNTRY. Both SUCK!

Congress has to reign in the courts - don't repubs. control that? Do-nothing spineless jellyfish. Heard of the Exclusions Clause? My beef with Bush is that he is afraid to say anything or take any leadership in it. Re-read my post.

FALSE! Read the Constitution. Congress has the power to ABOLISH ANY FEDERAL COURT under the Supreme Court, as well as make exclusions that will confine SCOTUS' behavior. In addition, IMPEACHMENT is available to the cowards in Congress - we could tar and feather those tyrants in the 9th Court and ride them out on a rail! Congress could put a stop to this nonsense in about 3 months!

To force congress to do this we need orginization more then sophistry. The Rats are in bed with the judicial activists, and the Pubbies are afraid of offending the increasingly rabid left wing bigots out there. While the conservatives are asked to watch are constitution raped like a cheap whore, and the "moderates" are clueless, and prefer to remain so.

I know one thing - writing Congressmen is a WASTE OF TIME. Mine didn't even bother to write back. The only thing that will work is grassroots activism, but I have no faith in the dumbed-down hedonistic masses either. I feel like the band of the Titanic who played their instruments until all was under water.

They are an issue with the Left only because the Democrats are going to lose the Governor's Office for sure. If the Democrats thought they were going to win, its hard to see Clinton & Co. letting the ACLU proceed with its lawsuit. What we have here are judicial fascists hijacking an election precisely because the Left is NOT going to be thrilled with the result on Oct. 7th - and they want to stop it instead of giving up power.

We should really get a million Californians to Morgan Hill and surround the building til ALL of the judges resign. That would send the black robed jack boot fascists a message. The people still have recourse and if judges violate the law, yes we will resort to peaceful means to force them out - lifetime tenure should not ever be used as a license to override the sovereign will of a free people.
