CA: 187 revival unlikely - McClintock is alone in advocating 'long shot' bid.

Tom McClintock wants to resurrect Proposition 187, taking advantage of the legal opening Gov. Gray Davis left when he settled the case and halted state appeals to uphold the initiative in 1999.

McClintock promises, if elected governor, to return to the courts with the 1994 initiative, which banned education and social services for undocumented immigrants.

The only alternative I see is to challenge the sanctuary statutes passed by local governing bodies and state governments.

"The courts have invalidated Prop. 187, and it's time to move on," Schwarzenegger spokesman Sean Walsh said. Schwarzenegger wants to put more pressure on the federal government to better patrol the borders and to reimburse the state for federally mandated services provided to undocumented immigrants. He has also suggested that a guest-worker program might be used to address the need for the low-wage labor many undocumented immigrants provide.

Bustamante is polling low -- only at 30% or so.

Schwarzenegger at about the same, McClintock about 15 - 18 points less.

If everyone who likes McClintock better than Schwarzenegger but plans to vote for Schwarzenegger because "Tom can't win" switched to McClintock, he'd be ahead of Bustamante.

Do the math.

In a general election the major democrat candidate would not poll so low and the "Tom can't win" would be valid. But in this unique recall election democrat votes will be less than usual.

Schwarzenegger should stay in the race to siphon votes from those who would otherwise vote Democrat. Conservatives should vote for McClintock.

Play offense not defense.

The $2.7 billion spent on education, while targeted for elimination by Prop. 187, is mandated by a 1982 Supreme Court ruling that says children can't be thrown out of school because of residency status.

Interestingly, this same 1982 Supreme Court ruling said that illegal alien schoolchildren can still be deported despite the fact that they can't be prevented from attending public school.

Combined with his call for allowing illegal aliens to remain here, that equals de facto open borders. Combined with Propositions 49 and 98, and with taking education spending "off the table", we may be looking back on today's deficits as the good old days.

The backers of 187 acknowledged the 1982 Supreme Court ruling. They sought 187 as a means to test it, in light of the court's more conservative composition.

In addition, the 1982 Supreme Court decision did not address welfare for illegals - only education.

And, as I recall, the Texas law failed to provide an economic justification. Arnold's desire to provide free educations for illegal aliens (and guest workers?) demonstrably works a tremendous financial burden on California.

We've both been here since 1998... The Free Republic of today bears little resemblance to the Free Republic of 1998. Everyone was so idealistic back then. What changed?

Can anyone explain why Ahnold followed up his appearance with Maria on the Oprah show where they pandered to the women vote, and then followed it up the next day with an appearance on the Howard Stern show where Howard only wanted to talk about the group sex from the Oui interview with Arnold. Did it dawn on Rob Lowe or whoever in the advisers that you can't pander to both sides within 24 hours? Just curious.
