To: Carry_Okie
Just because this question has been nagging at me, how does one determine when a treaty is unconstitutional? Is it limited only to the powers assigned to Congress in Article I, Section 8? Unfortunately, the text doesn't seem to compel that conclusion.

A treaty is unconstitutional when it exceeds the scope of powers granted to the United States by the people. It has happened.

To which text do you refer? If it's the stuff I quoted, I beg to differ, but you would need to read that book to really understand why.
