This message has been delivered more and more by Davis, Bustamante, and their supporters over the last few days.  We need to ask why, and ponder the implications.

Davis and Bustamante are planting not-too-subtle suggestions for one, or more, of the eleven women to step forward and file a criminal complaint against Arnold Schwarzenegger.  Everybody had better start asking why?  It may have nothing to do with keeping Arnold from being elected.  Grab your copy of the state constitution and read on.

Presume Arnold is elected on Tuesday, and the following day, one or more of these women does file a criminal complaint.  Under Article V; Section 10, the California State Supreme Court has full, uncontested authority to rule if such criminal complaint would deem Arnold to a position of disability pending the outcome of court proceedings.  Such proceedings could easily take a year or longer to complete.  In the meantime, Bustamante would be the acting governor.  This is very different from state impeachment proceedings which the legislature has control of.

Scary scenario folks, but the writing is on the wall, by way of suggestion.  What are the chances none of these women would file a complaint to keep Arnold from being governor?

I am absolutely certain of my analysis.  Yesterday, on a stop in Fresno, Davis refused an opportunity to discuss the recall with reporters.  Why?  Why would any political figure, especially one facing defeat, refuse an opportunity to talk with reporters?  Because the potential of criminal action is seen as an opportunity to have Bustamante become the defacto governor.

I hope no one gets angry with me for posting this.  I see something developing, and don't like what I see.

The Rats will do anything. By your description, this is possible. Davis is a pig and would try. Ahnuld is still the only one that can beat BustaMecha though.

You are correct, I have been researching the criminality aspects of this election since last night. They are going to try to nullify the election results pending an criminal investigation of Arnold.

I agree -- the Dems are not going down easy and there is nothing they won't do to maintain or regain power.

If Arnold gets elected and they can get him indited, then Bustamante, as the LT. Gov. would take over.

Yours is a scary scenario, but with the liberal judges in CA, anything is possible.

Most of this is "he said, she said", so I think in any real legal action Arnold would prevail, especially since these women said nothing for years, and are just coming out of the woodwork. But the whole thing could certainly try to derail Arnold's governorship.

This is all the more reason that we need to get Arnold elected and clean house, take California back from the Democrats NOW, or we never will.

I'd like to see some lawyers respond to this. In a number of instances where sitting governors have been accused of crimes, I can't think of any instance where the governor has been suspended or removed from office until after being found guilty by a judge or jury.

This is a somewhat different situation, certainly. If Arnold wins, he will not be a sitting governor but someone who has just been elected governor. Still, I seriously doubt that the Democrats could put off his assuming office for more than a few days. If the California Supreme Court refused to act expeditiously, I'm pretty sure SCOTUS would be virtually forced to intervene quickly in the case, whether they liked it or not.

But I doubt if even California judges would venture to act in such a manner. Even though the 9th Circuit judges are among the worst in the nation, they did NOT support the effort to delay the recall vote, which would have been easier to pull off than something like this.

I would suspect that the Republicans vetted Schwarzenegger, to find if he was involved in any felony level crimes. If Schwarzenegger were convicted of a misdemeanor, it probably wouldn't mean much as for as elected office were to go. If a felony prosecution did come up, the court might step in, but the person bringing the charge at this late date better have an asbestous wet suit on, becuase the judge will be asking some pretty damned pointed questions about why she didn't come forward before.

I'm curious as to why 2 days ago, Davis was saying that he wasn't going to comment, and that the voters would decide on Tuesday.

I guess the polls weren't looking as good as he hoped they would.

Is there no end to these mens lies?

The Democratic Party is akin to the Conspiracy of Catiline in late Republican Rome.

The Democrats have become a mere Faction, and therefore an enemy of the Republic.

It's really very simple. Arnold has said that he is going to bring in independent auditors to go over the state books.

If true, this could result in many California politicians being charged with crimes. They have been skimming revenues for decades. Many are directly connected to organized crime.

Arnold is more liberal than conservative. I don't think we would have seen these vicious attacks if he would not have threatened them with an audit of the books.

I don't know about the legal issues but it will be interesting to see the responce of the people of CA. They already seem to be PO'd at these folks.

Was this not corrected two days ago? Arnold said that he DID NOT admire what Hitler had done.

I wouyldn't lose any sleep over this. First of all, the statute of limitations has LONG since past over any of the allegations of criminal behavior, although it's possible Arnold could be sued in a civil action by the British broadcaster, as that action about 3 years ago.
