Washington D.C., May 16, 2009 / 01:12 am (CNA).- Encouraging Catholic universities and other institutions to act within the structure of the Church, Archbishop of Washington, D.C. Donald W. Wuerl has warned that those institutions which ignore legitimate instructions from the bishops weaken the Church’s "practical communion."
Writing in a Tuesday column in the Catholic Standard, Archbishop Wuerl noted periodic media reports about Catholic institutions apparently behaving at odds with their Catholic identity. He said the incidents often prompt discussion about the unity of the Catholic Church and how Catholic institutions relate to the broader Church. "Institutions that are recognized as Catholic and that exercise their ministry and activities as a part of the Church and in the name of the Church are not independent from the Church," he said. Such institutions must "live and act" within the structure of the Church, working "in solidarity" with the bishops who are responsible for preserving the unity of the Church. He noted that contemporary Catholic thought, following Pope John Paul II’s Apostolic Constitution "Ex Corde Ecclesiae," increasingly reaffirms the Catholic university as an "integral part" of the Church. The Catholic university must look to the bishops, especially the local bishop, to authenticate its claim to be "an expression of the faith and mission of the Church." Archbishop Wuerl characterized the U.S. bishops’ 2004 document "Catholics in Political Life" as a "practical judgment" about the path that best serves the unity and teaching of the Church, with the local bishop being responsible for its application. Though some disagree with a bishop’s application, Archbishop Wuerl said, "Communion in and with the Church obliges its members, even in practical decisions, to support the legitimate exercise of a bishop's responsibility… Otherwise, the unity of the Church becomes a theoretical consideration and the role of the bishop, who has the responsibility of unifying, is diminished." The archbishop cited the directive of "Catholics in Political Life" that Catholic institutions should not honor those "who act in defiance of our fundamental moral principles." Though Archbishop Wuerl did not explicitly mention the controversy over Notre Dame’s invitation to President Obama, the passage he quoted has been frequently cited in the debate. Bishop of Fort Wayne-South Bend John D’Arcy cited the same passage in a letter to Notre Dame’s president, saying he should have been consulted about the school’s invitation to and honoring of the U.S. president who supports permissive abortion policies. Archbishop Wuerl said the bishops’ document was "all the more significant" because of a contemporary mindset that suggests the bishops are "just one among many voices" offering direction and guidance to Catholics and the wider community "in the name of the Church."
When any Catholic institution chooses to disregard a legitimate instruction, the archbishop explained, "it weakens the Church's practical communion and fails to recognize the authentic role of the leaders of the Church." "Public honors are different from the internal affairs of a university, such as the formulation of its budget, the advancement of faculty or the regulation of normal student activities," he continued. "Honors are a public declaration in the name of the institution. They therefore automatically invoke the institution's self identity and very mission. Such action necessarily touches on the school's relationship to the whole Church community and its leadership." John Paul II’s "Ex Corde Ecclesiae," the archbishop said, helps to refocus on what it means to be an institution not only academically excellent and culturally engaged, but also one that is active specifically from its Catholic identity and heritage. Archbishop Wuerl closed his column with a call for renewed attention to how institutions may meaningfully express their ecclesial communion, Catholic identity and "practical solidarity" with the bishops. |
Relevant Canon Law:
Can. 752 Although not an assent of faith, a religious submission of the intellect and will must be given to a doctrine which the Supreme Pontiff or the college of bishops declares concerning faith or morals when they exercise the authentic magisterium, even if they do not intend to proclaim it by definitive act; therefore, the Christian faithful are to take care to avoid those things which do not agree with it.
Both the Apostolic Constitution Ex Corde Ecclesiae and the 2004 USCCB Catholics in Political Life are such documents.
Can. 808 Even if it is in fact Catholic, no university is to bear the title or name of Catholic university without the consent of competent ecclesiastical authority.
Comment: ND can have its right to call itself a Catholic University stripped.
Can. 810 §1. The authority competent according to the statutes has the duty to make provision so that teachers are appointed in Catholic universities who besides their scientific and pedagogical qualifications are outstanding in integrity of doctrine and probity of life and that they are removed from their function when they lack these requirements; the manner of proceeding defined in the statutes is to be observed.
Comment: although Fr. Jenkins is not solely at fault (his board of trustees can be forcing his options), it appears that he is voluntarily doing what he's doing: therefore, he no longer is outstanding in integrity of doctrine and probity of life, therefore, he is no longer qualified for the post!
§2. The conferences of bishops and diocesan bishops concerned have the duty and right of being watchful so that the principles of Catholic doctrine are observed faithfully in these same universities.
Comment: 74 (I think it's still 74) bishops have risen to the task. Now they need to do the next thing.
Can. 1369 A person who in a public show or speech, in published writing, or in other uses of the instruments of social communication utters blasphemy, gravely injures good morals, expresses insults, or excites hatred or contempt against religion or the Church is to be punished with a just penalty.
Comment: by giving a platform to Ø Jenkins has done just that. While Ø is not under Canon Law, Jenkins is.
Can. 1371 The following are to be punished with a just penalty:
1/ in addition to the case mentioned in ⇒ can. 1364, §1, a person who teaches a doctrine condemned by the Roman Pontiff or an ecumenical council or who obstinately rejects the doctrine mentioned in ⇒ can. 750, §2 or in ⇒ can. 752 and who does not retract after having been admonished by the Apostolic See or an ordinary;
Note Canon 752, above.
2/ a person who otherwise does not obey a legitimate precept or prohibition of the Apostolic See, an ordinary, or a superior and who persists in disobedience after a warning.
Here's a potential problem: Jenkins' "Ordinary" is the territorial superior of his order, not the Bishop of Fort Wayne.

Wuerl could have been so much more effective if he had joined the protests at ND campus and been led away in cuffs together with the 80-year old priest.

Not really. It can have its recognition by the Catholic Church as being Catholic stripped, but the Catholic Church doesn’t own the word, “Catholic.” Many “Catholic” universities, such as St. John’s and St. Bonaventure, have, in fact, been stripped of such recognition. But St. John’s markets itself as being a university in the “Catholic tradition.” They needn’t even be that delicate. Protestant denominations have long ago learned that they can call their Hispanic outreaches “Catholic Churches,” and the Catholic Church can do nothing about it legally.

That IS the potential problem. His ordinary and he are in lock-step agreement with their assault on the Catholic Church. I’ve been telling people that there is little Bishop D’Arcy can do, since even if he expels that little demonic band from his diocese, the University will just hire another demon, but there is one nuclear option:
An interdict.
Prohibit the eucharist from being offered at the University altogether, and prohibit local churches from offering the eucharist to students. Give one semester’s warning, so all the practicing Catholics can transfer. It can be done. The entire nation of England, for instance, was put under an interdict for exiling King Arthur to France in 1204, placing King John on the throne instead. (Yes, his name really was Arthur, no the legends of Arthur and Camelot preceded him.)
Wuerl has been silent about the even more grotesque outrages in his own diocese, where a Georgetown Law institute responded to the Notre Damned uproar by teaming up with NOW to present an award to Obama explicitly for his championing of abortion rights.
