Holder: 1st Amendment Allows Gov't to Force Catholics to Buy Sterilizat-Contracept-Abortn Insurance

(CNSNews.com) - The Justice Department will defend against any legal challenge to the new Obama administration mandate to force employers to provide abortion-inducing drugs, sterilization and contraception, even if it goes against their conscience, Attorney General Eric Holder told a House subcommittee Tuesday.

The Department of Health and Human Services rule, part of Obamacare, violates the freedom of conscience for Catholics and other religious groups that expressed their objections to the mandate, opponents say. Already there is litigation asserting that the rule violates the First Amendment’s guarantee to free exercise of religion.

“I think I would respectfully disagree in the sense that I don’t think the rule that HHS promulgated was one that ran counter to the religious prohibitions that are contained in the First Amendment,” Holder said.

“That’s especially true looking at the compromise the president and Secretary [Kathleen] Sebelius put in place,” Holder told the House Appropriations Subcommittee on Commerce, Justice, Science and Related Agencies.

President Barack Obama announced a change to the original rule that would have technically allowed religious institutions such as Catholic hospitals or schools to get an exemption from paying for these drugs, but instead require insurance to provide it for “free.” That so-called compromise would still require religious institutions to pay for insurance that provides the “free” services.

By that reasoning, I hope the Catholics use the 2nd Amendment against anyone showing up to force the issue.

I'm not sure if obummer isn't happy that this is going on with the Catholic Church.

If congress votes to overturn it, obummer can say it's the will of the people, sign the bill, and throw seebillust under the bus.

The Catholic Bishops will then be free to kiss his ass again, and the Catholics that were beginning to think, can go back to sleep.

That obummer, what a great mooselimb errr, Christian.

I think that most do not want a second amendment driven solution. That said, this is precisely the sort of behavior by government that drove Patrick Henry and other anti-federalists to the creation and forced adoption of the Bill of Rights.

Let’s not dishonor Patrick Henry by caving-in on these intrusions into the rights of the people without using all the tools that Patrick Henry fought so hard to preserve for us.

If Obama really wanted to avoid the issue he would just have HSS provide free abortion drugs. His intention is to wreak havoc with the Church and eventually, Christianity.

Only if you ignore the second half of the sentence "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof..."

The "compromise" was an accounting gimmick. I don't see how he thinks that it made any difference to the constitutionality of the issue.

Has anyone noticed that drugs, the purpose of which is to prevent the proper operation of the body, are described as “healthcare?”

I’ve noticed. The correct word for these kinds of drugs is “poison.”

Yep they are so are Amish.Why did they not exempt the Catholic church too?Could that be that many of us are in the 51% that do pay taxes?Seriously those of us who object to Obamacare should change our exemptions so that the government gets zero and at tax time file but attach a notarized letter saying since the muslims and Amish are exempted because of religion that as Catholics since you are forcing us to do things again t our religion we will no longer be participating with the government to include paying taxes

Holder is establishing atheism as an official state SANCTIONED religion.

Judges are just too stupid to get it.

remember most federal judges are real world refugees who found a job in the prosecutor’s office and then were government appointed into a judgship. NEVER worked a day in their lives in the private sector.

actually a few years back law schools did exactly that when they could not find qualified applicants. They simply accepted the highest people of [insert pc group here]. They were then marked for passage at any cost. Ivy league schools have such grade inflation that mere acceptance to the school guarantees a degree (unless the student confeses to voting for republicans)
