Tomasi explains that given the “refusal of obedience” was the grounds of the sacking it requires “religious superiors” to clarify the procedure.

From what I remember of the series of events, this was not the only reason he was fired:

1) He distributed condoms (against the teaching of the Church).
2) He lied about it.
3) He took steps to cover it up.
4) He refused two direct orders.

Numbers 1-3 should still have gotten him fired, even if he hadn't done #4.

Tomasi is trying to find any excuse to justify the investigation.
