SB 52, Scott. Firearms: handgun safety certificate.

Existing law generally regulates the transfer of firearms.

This bill would provide that, subject to various exceptions, no person may purchase, transfer, or receive a handgun, as defined, without a handgun safety certificate, as specified. This bill would provide that no handgun safety certificate may be issued to any person under 18 years of age. This bill would establish an application procedure for obtaining a handgun safety certificate, including the applicant's successful completion of a written test.

The bill would require the successful completion of a safe handling demonstration before a dealer would deliver a handgun, as specified.

The bill would provide that the provisions described in this paragraph would become operative on January 1, 2003...

This bill would make other conforming changes, including changes that affect requirements relating to the transfer or loan of firearms by firearms dealers and others, the violation of which is an offense...

This bill would provide that, except as specified, anyone who purchases or receives a handgun without a handgun safety certificate, or sells, delivers, loans, or transfers a handgun to a person who does not have a handgun safety certificate is guilty of a misdemeanor.

By creating a new crime, this bill would impose a state-mandated local program...

This bill would establish the Firearms Safety and Enforcement Special Fund to be funded by firearms transaction fees imposed on firearms dealers and fees imposed on certified instructors for the issuance of handgun safety certificates. The moneys in the fund would be continuously appropriated, and be available for expenditure for specified administrative and enforcement activities of the Department of Justice...

This bill would become operative only if AB 35 is also enacted...

This is a harsh infringement on handgun owners rights in California. The way I read the law, you could go out with your 14 year old son, let him shoot safely at shooting range, and be guilty of a misdemeanor offense for "loaning a firearm" to an obviously inferior individual. The reason he is inferior is because he doesn't have permission from elitist gun control politicians to handle a pistol. It doesn't mention it above, but you also have to give your thumbprint to the Handgun Safety Certificate (be halfway fingerprinted like a child molester) in order to make the certificate complete.

California gun owners should be outraged at the destruction of their 2nd Amemndmet freedoms! These are your freedoms fellow Californians, being sacrificed in the name "safety". I'm aware of the laws being passed in CA. This licensing bill is to make it so difficult to own a handgun that you won't.
It is MUCH better than the bill as originally proposed. -dbbeebs nra-life Californian

In New York State, the process to obtain a pistol permit is much the same. Without it, you cannot even hold an unloaded pistol in your hand, much less try one at a range, to see if you would be interested in the first place. The application requires completion of a safety course, four character references, fingerprinting, and a detailed driving record from the Motor Vehicle Department. You can't even get the application forms unless you happen to catch the police officer in charge of them in his office. Where I live, the backlog is about six months from the time you complete all of this and send in the application packet, assuming no red flags pop up.

Meanwhile, you can drive into downtown Albany to the drug district and pick up a 9mm semi-automatic pistol for cash, no questions asked, in less than an hour. All the better drug dealers and gang members have one (at least).

Inalienable rights cannot be "destroyed", and may not be infringed. They are non revocable God given rights. Criminals tyrants in government may pass and attempt to enforce such unconstitutional legislative acts, but anyone with any morals or ethics will oppose them.
