Dear Mr. Tancredo,
I am writing to you in response to your comments about INS law enforcement, made by you, on or about November 1st.
"I am afraid that they have totally abandoned the primary role of enforcement. Enforcement is not their goal. They really consider themselves to be social workers, rather than immigration enforcement officials."
This statement is totally out of line. As you know, INS has two branches with competing missions. On one hand, you have the Service Branch, your "Social Workers", who's primary goal is to flood the US with Immigrants that Congress wants and approves, and on the other hand you have the Enforcement Branch, who's primary goal is to enforce INS laws and regulations, and in the middle you have your Immigration Inspectors, who are tasked to do both jobs.
There are several factors that degrade the enforcement of Immigration Law.
1. Congress has enacted weak immigration laws, with loopholes big enough for an elephant to jump through, that can be exploited by the pro immigration groups and lawyers.
2. Congress has appointed "Social Workers" to run the INS. The Enforcement Branch and Immigration Inspectors both report to the "Social Workers" you appointed, and these "Social Workers" use your weak laws to keep us from deporting or removing aliens.
3. Congress gives Immigration Inspectors all the powers of a law enforcement officer, but refuses to recognize them with the pay and retirement of other federal law enforcement officers, and then allow the "Social Workers" you appointed to keep us from enforcing the laws.
I can think of no Border Patrol Agent, Criminal Investigator, Detention Officer, Deportation Officer or Immigration Inspector that thinks of them selves as a "Social Worker". Once again, your comment is completely out of line and incorrect.
The majority of terrorist that attacked the World Trade Center on September 11th, were allowed to enter the United States under laws Congress enacted.
To quote the former INS Commissioner, Doris Meissner "catching the immigrants who overstay the terms of their visas has been "a very, very low priority, and I think it should be a low priority".
Remember, Congress appointed this "Social Worker" to run INS, and she appointed other "Social Workers" to run her form of Immigration Policy, and Congress allowed it.
The Enforcement Branch of INS should not be held responsible for the actions or inaction's of Congress or its appointees. You can dump all the money you want into an agency, but if you allow the heads of the agency to mismanage the agency, you have accomplished nothing.
The fault lays with Congress, not the dedicated law enforcement officers and Immigration Inspectors that try to work under your broken system.

or is a promise to vote Democratic still sufficient to give any criminal a "pass"?

Because the media, like you, are ignorant, about INS laws and regulations and the environment Congress makes us work in.
The media reports that INS info was not shared regarding criminal backgrounds and expired visas. Is it true? Why?

I don't want to change the subject and ask what you think of the Elian Gonzalez debacle. But, what do you think about that one?

When you are hired as an Immigration Inspector, you are told you will be enforcing to laws and stopping criminals from entering to country. You are then sent to the Federal Law Enforcement Training Center, for training.
Once you get to your port, mine was in Arizona, you discover that all your law enforcement ability is taken away by your district director, who spent 20 years in the peace corps, and wants to give America back to Mexico.
It is very frustrating to have all your decisions reversed, because you higher ups don't want to enforce immigration law. And Congress allows this to happen.

Because Congress allows the State Department to issue theses visas. The INS has no control over this and can not deny entry to someone who has not broken the law. This is what my letter is about.
I believe Elian should have been returned to his father.
As for going in like a SWAT team, I don't know. I was not in on the raid and do not know what intel they had. I heard they were informed that there would be weapons in the house, and as such you must take precautions. On the other hand, this was a small boy and should have been handled differently. IMHO.
