The 1983 statute is clear: "Any member appointed to fill a vacancy shall serve for the remainder of the term for which his predecessor was appointed."

Somebody should print this out on a big sign and show it to Katy Couric & Co.. The media folks are making this out to be some sort of illegal power play by Bush trying to destroy the integrity of the Civil Rights commission. To hear their reports you would never guess that it is Berry herself who is VIOLATING the rules of the Civil Rights commission.

They do not listen to Zell Miller. The AG ought to send a couple of US Marshals to aid in seating Mr. Kirsanow. Just in case there is any obstruction to his lawful appointment. Berry picking is a delightful experience.

I watched about 5 minutes of the meeting on C-SPAN and it was a total waste of airtime. The "Civil Rights" commission's funding should be eliminated.

The mistake the WSJ is making here is assuming that an adult Demorat (if they were to find one) would be honest, rational, and have his/her country's best interests at heart.

This is the only place I was able to find the UNITED STATES COMMISSION ON CIVIL RIGHTS ACT OF 1983 in total:
SEC.2.(b)(2)(B)...any member appointed to fill a vacancy shall serve for the remainder of the term for which his predecessor was appointed...

The United States Commission on Civil Rights, first created by the Civil Rights Act of 1957, and reestablished by the United States Commission on Civil Rights Act of 1983, is an independent, bipartisan agency of the Federal Government. By the terms of the 1983 act, as amended by the Civil Rights Commission Amendments Act of 1994 , the Commission is charged with the following duties pertaining to discrimination or denials of the equal protection of the laws based on race, color, religion, sex, age, disability, or national origin, or in the administration of justice: investigation of individual discriminatory denials of the right to vote; study and collection of information relating to discrimination or denials of the equal protection of the law; appraisal of the laws and policies of the United States with respect to discrimination or denials of equal protection of the law; maintenance of a national clearinghouse for information respecting discrimination or denials of equal protection of the law; investigation of patterns or practices of fraud or discrimination in the conduct of Federal elections; and preparation and issuance of public service announcements and advertising campaigns to discourage discrimination or denials of equal protection of the law. But th(c) Terms
The term of office of each member of the Commission shall be 6 years
e subsequent legislation is very clear too.

Folks, remember when we argued in Florida that SHALL means MUST. The new legislation dropped ths vacancy language from the 1983 text. Don't be lulled into thinking Berry has no case. She has the plain meaning of the text on her side. According to th plain reading no one can be appointed for less than 6 years irrespective of putting a limit on he term by the president.
