foreigners in the US do not have gun ownership rights. On what do you base this??? What other rights do foreigners not have? Does the Constitution not apply to them at all?

There is no reason why a foreigner on a visa is prohibited from owning a firearm. When that Jordanian idiot opened fire in the Empire State Building, also with a .380, the feds enacted a rule that you have be a resident of your state for three months prior to purchasing a firearm. This only applies if you are an alien.

foreigners in the US do not have gun ownership rights. what the hell is this suspect doing with the piece? Sure they do, as much as anyone else anyway. As long as they are legal residents that is. The second amendment protects "the right of the people", the Supreme Court has ruled that "the people" as used in the bill of rights, includes more than citizens.
While this textual exegesis is by no means conclusive, it suggests that "the people" protected by the Fourth Amendment, and by the First and Second Amendments, and to whom rights and powers are reserved in the Ninth and Tenth Amendments, refers to a class of persons who are part of a national community or who have otherwise developed sufficient connection with this country to be considered part of that community.
