You can't afford to pay your debts, so you are taken to jail, this should be considered beyond the power of the law, it is debtor's prison.

Not the way it works. You work and do not pay child support. You have the money but hide it to avoid paying child support. That is fraud and thus you are jailed for a form of fraud. If you can prove you were and are unable to pay the child support then you are not jailed. Although this may leave you with precious little to live on.

Most people jailed have made real efforts to avoid paying child support. They could have paid but instead they paid for other things cars, boats, homes, new marriages etc. Many change their names move and make sure they get paid in cash. Some even refuse to take jobs they could get and live off a new spouces income. In all these cases these cases these people should go to jail.

So what happens in my case? - (As I mentioned on other threads) My x wife adopted the boyes over 2 years ago and intentionally did not tell CSEA and then tried to get me to pay her additional money before she would turn the paperwork over to them to stop child support from coming out of my check. Now CSEA found out the truth, what I have been telling them two years - is she guilty of fraud? Where is my money? It still comes out of my check until a judge signs off, but that money is not going to her and will be refunded. Personally, I am glad I am all done with the mess, but still I am pi$$ed off that she gets away with fraud and not letting me see my kids for 4 years. Oh well.

Why should the man go to jail for living off his new spouse's income? Lots of women double-dip the same way, but nobody would think of coming after them for fraud when their new husband could be paying the childrens' bills.

If you are going to propose that people be sent to jail when they are receiving private assistance and not paying child support, why don't you also propose the same thing for people who are on public assistance when they could be working? There is almost no incentive for a woman to stay married if she wants to live for free and make her husband's life miserable. The state will roll out the red carpet for her.
