The legislature passed a new law. It did not strip the court of its ability to interpret the law. I fail to see how, in passing new legislation, the Florida legislature exercised a power appertaining to the judiciary. How is the case at hand a separation of powers issue?

Hmmm... a nice find I guess, but all it merits is a "So what?" Legislature writes a new law, carried out by the Executive, and written terse enough and specific enough to diallow misinterpretation by the Judiciary. Now, unless it is deemed unconstitutional, and I can't see how it can be rendered as such, the law stands; regardless of how it was conceived.

yes, the video editing bothers me quite a bit. I'm fairly new to reading about this cause, but I was willing to believe her supporters lock, stock and barrel before finding out how those video's were produced. The terri-cable.mov file I saw (8-11-2001 IIRC) appeared to be one continuous, long take. For parts Terri seemed responsive, for other parts not. Downloading the 10MB file was a pain though. Editing a file to reduce bandwidth may have been a reasonable technical decision, if a foolish evidentiary one.
To my mind, a bigger issue is why Judge Greer was so interested in having Terri railroaded without a guardian ad litem. A GAL is appointed as a matter of course in cases where there's a small possibility of a conflict of interest, much less where there's any actual action contrary to interest.
A more appropriate question to ask would be "Why should I consider anything MS says to be untrue?"
Please reconcile the following statements (feeling free to correct any inaccuracies).
- Terri is just a mindless body.
- Certain things must be forbidden because they might 'distress' her.
- This recent rehydration is excessively cruel.
- I want Terri to die with dignity.
- (Terri was kept in a room away from loved ones and supervised by mother-in-law while she is dehydrated.)
- Attempts at oral sustenance are forbidden because they might cause her to choke.
- Terri is to be starved/dehydrated to death because she can't survive without a feeding tube.
- Terri can be rehabilitated and expect to live a normal livespan -- Michael Schiavo before winning a malpractice award for himself and Terri.
- Terri wants to die and should be killed as quickly as possible -- Michael Schiavo after winning a malpractice award for himself and Terri.
- It was hard for me to accept the judge's ruling.
- (Michael himself sought the judge's ruling).
Need I go on? If I'm wrong in attributing any of the above claims to Michael Schiavo please let me know.

Actually, unless Michael's current domestic partner is brain-dead herself, she is aware of how this could impact her children's future. For all we know she is telling him to cool it. To think of her and her children.
I sure would hate to be in those shoes, about to give birth, and my husband embroiled in something like this.
Some will say her behavior speaks for itself. It speaks but it doesn't say everything. We know nothing else about this woman, she could be young and naive and psychologically vulnerable to a controlling type. I'm hoping her priorities are shifting and she can influence him for the better.

Has there been any discussion as to who is paying for all of this care? If it is the state, is this case really an example of where we want our medical subsidy dollars to go? I am just curious as to your opinion. As you know, I am NOT is favor of spending mucho government dollars keeping alive folks in their eighties into their nineties, particularly if in a decrepit state. I am in favor of a triage system.

The hospice is providing it gratis, most likely because Felos (on the Board of Directors when Terri entered) didn't want to set of alarm bells by paying for it from Terri's trust.

I am conjecturing that if the hospice isn't charging anyone for Terri's stay, some of the restriction that would normally apply might be eased. I don't know, but maybe it could claim to be a hospice for everyone else and a free boarding house for Terri or something.

That's a false statement Take it up with the Judge.

The docs didn't just misdiagnose, they lied. They perjured themselves for the record and Judge Greer played a part in that.Welcome.

Very few are which is why most of us have living wills. But the state can not make issue decrees that 39 year old women be straved to death when their is more than reasonable doubt as to her wishes and her prognosis.

Ya, but suppose the state has to spend $200,000 a year to keep her alive? I don't think it is a mere matter of feeding. Maybe it is in this case due to special circumstances, I don't know. Of course, it Terri has insurance which covers this, then my comments are inapposite.

It is a mere matter of feeding, changing diapers and keeping her clean and happy. Not much cost invovled there, they can do it at home. The rehab has associated costs but in this case there will be none because those services have been volunteered.

She has no need to be in hospice, the only reason she's been there these years is because Schiavo and his Ghoul see that as the kicking off point so to speak.

May I suggest you take a look at
this QuickTime movie with Terri interacting with her mother? It takes about five minutes, and there's not one single edit the entire time. She laughs, she smiles, she tries to speak to her mother, she follows directions, she looks her mother in the eyes, she looks over at her dad and then back at her mom when her mom says, "Look at me." I challenge you to look at that entire movie and THEN come back and say whether or not the Schindlers are delusional about her PVS state, or that she is merely "reacting to stimuli" as you put it. Five minutes, that's all it takes. (That, and a program that will play movie files.)
