Greta: After 13 years in a vegetative state, Terri Schiavo's husband won the right to have her feeding tube removed. Then on October 21st Terri's law was passed by the Florida legislature. And Governor Jeb Bush ordered the feeding tube RE-connected. Michael Schiavo has sued the Governor, charging his actions were unconstitutional.
Greta: We are joined now by Governor Jeb Bush's lead attorney in this case, Ken Connor. Nice to see you, Ken.
Greta: Ken, now, first of all, do you agree she is in a vegetative state? Is that ahh, is that what the Governor believes too?
Connor: Yes and that's what the statue provides... that when you have a situation where one is in a persistent vegetative state, that had no PRIOR written advance directive, about what they would want to have done to them under these circumstances...
Greta: Does it have to be in WRITING? Is that the way the statute is written?
Connor: That's right.
Greta: So, if I say to you tonight: "listen, make sure, if something happens to me, I want to be disconnected" Thats not enough in FLorida?
Connor: Well, in THIS situation, where you ALSO have a family DISPUTE, and where nutrition and hydration are being withheld, the law says now you're entitled to a Guardian Ad Litem, to determine what your desire and INTENT was.
Connor: In THIS case, Terri Schiavo never HAD the benefit of a guardian ad litem. Her HUSBAND who SERVED as guardian, had CLEAR conflicts of interest, standing to gain financially from her death, living with another woman with whom he'd conceived two CHILDREN.
Greta: But, but, at this point - - - Alright, he's got two children now with a girlfriend... Umm, and ahh is, what do you think his MOTIVE is? I mean, HE says his motive is because his wife told him that she wouldn't want to live like this. Do you QUESTION his motive?
Connor: Look, its not for ME to determine what Michael Schiavo's motive is...
Greta: But what do you THINK?
Connor: I'm not going to GLEAN his motive. The PARENTS have sharply questioned HIS motives. Michael Schivo has-
Greta: What do THEY say? Do they say its MONEY?
Connor: Well they say he stood to gain financially from her death...
Greta: But THATS the PAST.
Connor: ...they recovered seven hundred THOUSAND dollars on her behalf...
Greta: But THATS OVER
Connor: ...four HUNDRED thousand of which has been spent NOT on improving the QUALITY of her life, but in LAWYERS FEES, to have her STARVE to DEATH.
Greta: But right NOW Ken... I mean, you know forget THAT... right now, does HE stand to gain FINANCIALLY if she dies?
Connor: Well, there have been some questions raised by the parents about ahh, multiple traumas which Terri supposedly suffered under circumstances... Multiple FRACTURES which Terri supposedly suffered under circumstances that were consistent with TRAUMA. And THEY say the circumstances have never been adequately investigated.
Greta: Has any doctor?
Connor: Look the Governor has only been in this case for TWO weeks.
Greta: I know. Have any of her doctors? that she's had a tremendous amount of treatment, over the last 13 years... or at least a lot of medical care... Has ANY doctor who's TREATED her, thought that there was ANY foul play involved in her vegetative...
Connor: According to the Schiavos... [I think he means Schindlers] ...according to the Schiavos, theres a medical report in her records, that indicate a BONE scan says she had MULTIPLE fractures consistent with TRAUMA.
Connor: The Schiavos- the Schindlers, sought to have those circumstances investigated... the state attorney DECLINED to do so, saying well, the statue of limitations has already EXPIRED. But the Schindlers have been in the position, that if this is the CASE, then it goes to the issue of MOTIVE.
Connor: Whether or not Michael is telling the truth, or trying to cover up? We don't KNOW what what the circumstances are.
Greta: Is, is, in the last 30 seconds we have, is this, I mean, is is, is Terri Schiavo for better or worse, sort of CAUGHT in an ongoing battle between the ACLU and right to life? I mean, you're associated with the right to life, and I know that ACLU has helped Michael Schiavo... But is she caught between those- that ongoing battle?
Connor: No. What she's caught between, are PARENTS who are seeking to preserve her LIFE, and protect her interests. And whose seriously challenged whether or not her husband HAS her desires OR best interests at heart. Or whether or not he is seeking to advance ahh, some kind of secondary GAIN by virtue of Terri's death.
Connor: What THIS law does is provide that a GUARDIAN will step in, to INDEPENDENTLY investigate the circumstances of, relating to Terri Schiavo, and who makes a report to the court, AND to the governor, who ahh, will ultimately will have the discretion about whether the stay or not will be lifted.
Greta: Very important issue Ken, I'm sorry to cut you so short on time, but we don't have enough, cause its a HUGELY important issue, but ah, I hope you will come back. Thanks.
Connor: Thank YOU.
Greta: All right, lets bring our expert panel in, Gloria Alred whos a victims rights attorney, Jayne Weintraub whos a defense attorney in Florida, and forensic pathologist Dr. Michael Baden.
Greta: Dr.Baden, I want to start with you since you are a doctor... I mean, TERRIBLE situation on a, on the hands ah, in Florida, going on... What do you think about this?
Dr.Baden: Ahh, I think doctors are trained from early medical school, to save lives and to keep patients alive. Times arise, when theres a CONFLICT, between treatment and families... such as to give blood to a child, and the family doesn't wish it... such as should we FORCE insulin on a diabetic prisoner who refuses to take it... And traditionally, these are solved by the courts. So the courts usually make the judgements, of what the doctors should do.
Dr.Baden: Bringing in the LEGISLATURE, is a troublesome aspect, because thats another LAYER, to bring in... but, but I think EVEN withdrawing the FEEDING tube, and the ah- is troublesome too. She's right at the BORDER ahh, medically, of whether we should permit her to die of dehydration or not.
Greta: Alright, Gloria, your thought on this?
Alred: Well, its a very complicated situation ah, espec- its PAINFUL for ME because my FATHER was in a coma, and I had to make decisions as to whether to withdraw food and water, and I WOULD NOT withdraw food and water.
Alred: But in any event, I do think the central aspect of it, is WHAT would SHE have WANTED. And EVERYTHING flows from what the individual would have wanted to choose. And in addition, whether or not she is truly IN a persistent vegetative state. And, I think that, of course the courts have FOUND that ah, because of the testimony that was GIVEN by Michael Schiavo and some other members of the family, that she would NOT have wanted to stay alive.
Alred: On the other hand, it appears that the PARENTS contest that. I say THIS... Look, if there REALLY IS a dispute, and IF it isn't clear, although the courts have said that it IS, then the PARENTS are apparently willing to take her in... willing to PAY to care for her... Perhaps it SHOULD be DONE.
Greta: Allright, I've got 30 seconds Jayne, give me a prediction on who's going to do? Who's going to win this?
Weintraub: Well Greta, the courts already have DONE it. I mean, and Jeb Bush, you know, like SuperMan, goes into a phone booth, and gets his [unintelligible] extension...
Greta: Whats the ruling here. Without all the editorializing, who's going to win Jayne? I don't have time ahh...
Weintraub: I, I hope that Terri's LAW, becomes Terri's WILL. And Greta, the ANSWER to your question is, in Florida, there's specific statute when there is an ABSENCE of a living will, and in this case, the court took medical evidence from her DOCTORS, as well as from Michael Schiavo, and made a determination to LET her DIE with dignity under our statute. The Governor does NOT have the RIGHTS to overturn that.
Greta: And like with Ken, I've got to apologize to ALL of you, because its obviously not a SIMPLE issue, and I apoligize we didn't take MORE time with it. Gloria, Jayne, Dr.Baden, Thank you.

There Greta, in her on ignorance has framed the question exactly and put the battling powers in there place. But she thinks, just like the ACLU, that right to life is something believed in by right-winged kooks. How does someone whose names suggests a belief in Civil Liberties take the side of state sanctioned right to death. How? SHE thinks that by pinning labels on people, she can show that it is JUST political. But words have meaning, sometimes even the words that soft-headed leftists mistakenly use.
Unfortunately, it has come down to a battle between right to life and the ACLU representing apparently the opposite, and the only opposite of a right to life is a right to death. As WFB once said, principles have edges and they can cut sharply.
