It makes him someone who in a time of war continues to keep the borders of his own country UNDEFENDED. What do you call someone like THAT?

It's a good thing that a person wants a better life for themself and their family. But there is no good excuse for violating the law in order to try to achieve that better life. A lawbreaker is a lawbreaker, regardless of what their motivation was for violating the law.
