Id agree that this marine probably should not be convicted of criminal charges. However, I dont think that his actions were necessarily justifiable either. It is an unfortunate situation, and its tough to know the facts from that short clip of video. You cant get a good idea of the context. I think there was enough doubt in the Marine's mind about the status of the terrorist. The Marine did the right thing.

I got an idea. You said: NBC's embedded photographer is out to demoralize the U.S. Marines.
SO, let those NBC embedded photographers and reporters"go in first" so that they can get the "best shots" -- if you catch my drift.
THEN, our Marines and Soldiers and the Coalition of the GoodGuys, can follow behind and "take care of business."
