What is Private Property? Wayne Hage's battle to protect private property -- his and yours After fourteen years of courtroom battles to regain control over the property he claims was taken from him, you could say that rancher Wayne Hage knows a thing or two about private property, the law and government coercion. Tonight, Michael Shaw, Abundance Ecologist, will host a discussion with Hage during a special two-hour edition of the Freedom 21 radio show.

Hage, whose wife Helen is a former member of Congress, will tell of his winding journey through the courts after federal agencies pushed him off the land and criminalized his normal ranch operations. He will describe how the government has lost all semblance of respect for the institution of private property (which undergirds all other rights), and how the implementation of Sustainable Development policies will eradicate liberty and justice for all.

Whether you're a rancher, a suburbanite or a city dweller, this show is sure to give you something to think about. This radio show broadcasts tonight on the internet and live in selected stations nationwide. Mr. Hage is a staunch defender of property rights and is an eloquent speaker worth listening to.

Tell me about it. The Gov't is just as bad as a home owners association. Mine is dictating to me about my modest and tasteful Christmas light display being in violation. After really reading the covenants for the first time, I realized that they (D.R. Horton, the developer)own it and I make the payments!

I hope he goes into the subject of land patents, land grants, alodial titles and the prominence of treaty over law.

Otherwise, he is just another poor stiff that FDR took land ownership from in 1933 to finance the debt.

It ultimately boils down to ownership vs possession.

Since 1933, we are largely a nation of land possession; at the whim of the government's debt.

Our county is pushing a community plan for our town. Community plans effectively place covenants with the county on private property that never had any before.

The person who is head of the "community plan" committee works for the USDA and the USDA is pushing community plans nationwide.

Like your homeowners association, the government wants to own all the land and just grant you the privilege of paying taxes on it.

You might write to D.C. to get your land patent. Land Patents have been held to supercede local covenants (especially HOA covenants) in the few times they have been used to fight overweening officiousness. Of course, once you get a copy of your Land Patent, if you are really serious about this, I'd get a good attorney and come down on your HOA like a ton of bricks.

However, you may not even need the Land Patent. One thing I've noticed about HOAs in general is that, while they are bullies, if you threaten to sue the board members individually, quite often they'll back down.

Its not often you hear a person advocating property rights in public these days. In the communist county of Santa Cruz, property rights are something to be done away with.

Its terribly frustrating that people don't realize that America cannot be the land of the free without the right to own property free and clear.

The Liberal GovernMental EnvironMentalists and Homoaners Associations, think it's just fine if you "own" it as long as they control it!!!

Ownership of anything, without control, should be ruled illegal and unconstitutional! Any impingement on the control inherent in ownership exerts a chilling effect on the reasons for ownership (and financing) and demeans the value of what is owned!!!

Only in cases where my rights of ownership and control interfere directly with your rights of ownership and control of your property, should there be litigation or compromise between us as owners of our controlling interest!!!

It's always a good idea to thoroughly read any homeowner's association documents, particularly bylaws, before purchasing any property associated with that association. In fact, it's a must-do thing.

Not only that, but you need to check to be sure those rules cannot be easily changed by the sitting board. Only by doing that can you make a good choice.

As you're finding, HOA's can completely control your use of your home and surrounding property.
