That is because he will be on the list for SCOTUS when a vacancy opens.
All the ones in my comments, not all the ones in the White House press release. And not voted down, not allowed to be voted on, in a straight up-or-down vote, on the floor of the Senate, due to the Dems playing the filibuster nuclear option.

I have a question concerning Richard Griffin of Michigan:
Is he one of those carryover Clinton appointees that Carl Levin and Little Debbie keep insisting on, or is he genuinely a Bush nominee?
IMHO Estrada will be held in reserve until a SC spot opens up.
