Woman punished for being raped by father-in-law
Wednesday, June 15, 2005 (Muzaffarnagar):
Twenty eight-year-old Imrana had sought justice when she complained of rape by her father in law Mohammad Ali.
Instead, the panchayat dissolved her marriage to her husband Noor.
The head of a local Islamic court, which will hear her case on Friday, has also said that Imrana can never remarry her husband, as she is now symbolically his mother.
Meanwhile, her father-in-law has been arrested and will be produced in court on Thursday.
Shocking allegations
The maulvis also said Imrana must have invited the attack, and both she and her father-in-law must be made an example and severely punished.
Shattered, Imrana still says she will respect the Shariat's decision.
Many privately say this is not the first time Mohammad Ali has sexually assaulted a daughter-in-law. In previous cases, his other sons moved away with their families instead of complaining.
Shocked at Imrana's predicament, the National Commission for Women has decided to intervene and asked the Uttar Pradesh government to present a report within the next seven days.
'No authority'
Meanwhile, contradicting the diktat of the local Muslim leaders, a member of the Muslim Personal Law Board has said the Shariat law gives a panchayat no right to decree a divorce.
Zafareyab Gilani, the MPLB member, also said the matter was one between a husband and wife.
He said if Imrana's husband had not given her talaq, the marriage remained intact.
He added that rape is a "criminal offence", and under Islamic law Mohammad Ali would face a death penalty. He said Imrana could not be victimised.

I don't much about the law in India (actually nothing) but I am surprised that Sharia can supercede the law of the state.
