This court is gotten so far out of line, it is almost treasonous. They are basing decisions on public opinion, on international law, on international opinion. What ever happened to basing decisions on THE CONSTITUTION??

I can gues how the 5-4 split went. Ginsberg, O'Connor, Souter, Stevens, Breyer on the side of allowing property to be seized for economic development and Rhenquist, Thomas, Kennedy, and Scalia against.
Rhenquist (80) will be the next to retire and them probably Stevens (85).
Property rights are not given explicitly in the Constitution. They are implicit only in the 4th and 5th Amendments. Property rights come through the State through the legal system.

I really blame George HW Bush [who appointed Souter] and the RINOs who were behind appointing Kennedy and evenJp Stevens and O'Connor. Why do we blow so manyopportunities to structure the court while the left gets Ginsburg and Breyer types --even when we control the Senate? The answer is RINOs like Orrin Hatch and other weak kneed phonies.
I don't think you're overreacting, the recently deceased Fifth Amendment read ".....nor shall private property be taken for public use, without just compensation".
