Sad incident, but seems like his finger should have been on a radio calling for back-up, not firing warning(?)shots up in the air in a large, open crowd.
I looked at the photos from the web site and I don't see a badge in any of them. I must be missing something. Regardless this is a terrible shame for all involved.
Looked at all the photos. Didn't see the claimed "apparent badge." And though this situation is absolutely tragic, I'm not surprised it happened. ATF agents have a long reputation of making bad situations far worse than they should be. This looks like another in a long line of ATF "arrests" gone horribly wrong.
I don't get the "interstate commerce" connection that would give the federales jurisdiction. I thought underage drinking was a local issue.
If anyone can elaborate on the circumstances which required this guy to put a GUN TO THE SUSPECTED UNDERAGE DRINKER'S head I would be appreciative.
Seeing from this angle, the kid in the black shirt is certainly in fear for his life and the reasonable man test would tend to support removing the green-shirt attacker with NO VISIBLE MARKING from this angle from the threat position.
It seems excessive for an undercover officer to start firing his weapon because of a few drunk guys tailgating. I wonder if the officer had any liquor in him at the time...
