In an initial chat with Miers, according to several people with knowledge of the exchange, Leahy asked her to name her favorite Supreme Court justices. Miers responded with "Warren" -- which led Leahy to ask her whether she meant former Chief Justice Earl Warren, a liberal icon, or former Chief Justice Warren Burger, a conservative who voted for Roe v. Wade . Miers said she meant Warren Burger, the sources said.
A Republican member of the committee, Lindsey O. Graham (S.C.), said after meeting with Miers: "I think the hearings matter in her case probably more than others."
Graham said Miers's challenge will be to "create a comfort level" with conservatives that she shares their strict-constructionist approach to interpreting the Constitution, while convincing the public that she is not biased by her evangelical Christian faith and is qualified for the lifetime post, despite her lack of judicial experience.
Graham said he was "very impressed" by Miers and said the two had discussed her work history and how she had dealt with various types of conflict throughout her career. He described her as a "consensus builder" and a "task-oriented" person.
Brownback said his biggest concern is not knowing where she stands on "key issues of the day," such as abortion, same-sex marriage and property rights. He said that during the meeting, he brought up the Roe v. Wade decision on abortion in the context of another case, and said Miers "did not and would not" articulate a position -- presumably, the senator said, because Roe remains a "live issue" before the court.

This passage is even scarier. Something about it doesn't smell right. How could Miers, in response to Leahy's question, simply have responded "Warren" as if she were old buddies and on a first-name basis with friggin' Warren Burger?? There's that smell again....

As trusting as you when you bashed Leahy for asking it. Regardless, we'll all know the truth of this later today. If false, it's not something the White House can ignore.

Because she meant Earl Warren and upon realizing her faux pas, took the lifeboat Leahy offered. Too bad that lifeboat's as leaky as Leahy.
She'll be a consensus builder, she'll vote right along with Scalia, Thomas, Roberts, and the four of them will bring Kennedy along in their corner.
This was a horrible nomination. The hearings will once again be a meaningless and uninformative TV show starring some blowhard Senators, and in the end we conservatives will be left with nothing else to do but cross our fingers and hope that Miers turns out to be no worse than O'Connor. Wow. That's just great.
Bush had an opportunity to create a brilliant legacy and save the nation from the onslaught of the Euro-style secular socialism that the Democrats have been foisting on the nation through the courts for decades. This was the biggest, most important decision of his Presidency. And Bush blew it.
The magnitude of this blunder cannot be overstated.

Unacceptable. The Constitution is explicit about saying powers not enumerated in it are reserved for the states and the people. As such it's a states' rights issue - thus it must be overturned to reassert the balance, at the very least, between the federal government and the states.

Three: her first thought was Earl Warren. After all, at first she said, "Warren". It seems odd that she simply referred to Burger by his first name. If true, this would be terrifying!
I don't know what to make of it. One thing is for sure: I don't know of anyone who is a serious Supreme Court observer who would have referred to a SC Justice so informally. Laura Ingraham, who clerked for Clarence Thomas, never refers to him as "Clarence," always "Judge Thomas." Calling Burger "Warren" is like referring to Justice Rehnquist as "Billy," or Justice Byron White as "Whizzer." It's unseemly.
I was horrified by the dumping of federal cash on that situation. We know what happens when such massive spending occurs - it's rarely anything good.

I do too. Which begs the question: just what the hell is Bush Jr. trying to pull off here, aside from the obvious cronyism?
I'm beginning to think all this criticism of poor Harriet is a gigantic Freeper conspiracy to trick the Democrats into thinking she is one of THEM.
Or . . . maybe you people are just running amuck.

Or maybe we're actually very concerned about this pick and what it means. No one has dared suggest that she is more qualified than Luttig, Owens, Brown or Dinh for a very good reason...she is not. In reply to this critique, I've heard nonsense, such as accusations of "elitism" and that the Constitution is so simple that anyone could understand it - which is not particularly useful when one is trying to someone to lay the smackdown on leftist "intellectuals".
Grow up, and understand that people are genuinely worried, not always involved in a conspiracy.

The more I think about it, the more it makes sense that Burger would be her favorite. Burger, like Miers, had humble beginnings - he was a night student at the St Paul College of Law, and worked in private practice for 12 years, before becoming a deputy AG under Ike. Burger is remembered more for his administrative skills in running the courts than for anything he wrote.
