What do they expect, to be on the President's speed dial everytime he makes a decision that he's entitled to do?

Bush has an obligation to keep his promise to appoint a Scalia-like originalist to the court.

Only the brain-dead believe conservatives should let the President get away with appointing yet another stealth nominee when such a strategy has repeatedly failed for 25 years.

Until conservatives as a whole get a brain and demand known originalist be appointed, nothing is going to change on the court.

Some FReepers need to get a brain and look at her record rather than continue the banter of "stealth" nominee. Just because you don't know what her record is, that alone doesn't make it invisible.

Scalia was also a stealth nominee who got approved 97-0 when the rats controlled the Senate !

Correction.

Until conservatives as a whole get a brain and demand an end to the unconstitutional filibuster, nothing is going to change on the court.

That's been my position since the filibusters were first concocted by Kennedy, Clinton, Schumer et. al.

Until the filibuster is gone, 55 doesn't mean sheet and a super-majority means everything.

And we're not gonna get a super-majority by demanding only *known originalists* when we haven't defeated the filibuster ourselves. Defeating the filibuster provides the necessary credibility to demand that only *known originalists* are nominated.

The filibusters were implemented after Bush's campaign promises were made. He deserves considerable deference when conservatives haven't removed the obstacle to their own goals.

That's exactly why he nominated Miers. Because he knows her and has more faith in her to be that kind of Justice than anyone else he could name. He is willing to stake his legacy on it. So what do you hope to accomplish by continued criticism? What do you want to see happen now?
