Dog Owner Indicted For Animal's Attack On Boy
POSTED: 9:53 am CDT October 13, 2005 UPDATED: 10:05 am CDT October 13, 2005
WACO, Texas -- A man accused of sitting on his front porch drinking beer while his pit bull-terrier mix attacked a 9-year-old boy was indicted.
A McLennan County grand jury on Wednesday charged Jorge Grijaiva Cardona, 42, with injury to a child, a felony with a maximum penalty of two years in a state jail.
In May, Cardona's dog bit an elementary student in the right arm, right leg and rib area while the child rode a go-cart in front of his own house, according to reports.
After the boy's family members rushed to help him and chased the dog away, he was treated at a local hospital and released.
Cardona, who was "heavily intoxicated" when investigators talked to him that afternoon, was on his porch drinking beer during the attack, according to police reports.
Cardona is charged with acting recklessly by not having the dog restrained and by not coming to the boy's aid.
Animal control officers seized the dog, and reports do not indicate what happened to the animal.
You've made your point. You own a pit bull. I understand. You have no sense of humor about the topic at hand. Now go play with your dog. :)
I was totally unaware of the danger to society brought on by the Cocker Spaniels. The media must be supressing the stories about vicious Cocker jaws crushing human windpipes.
Which topic is that?
Dog bites?...Nope no sense of humor there.
Irresponsible dog owners?...Nope no sense of humor there.
Distorted and sensationalized media reports whipping up hysteria...Nope no sense of humor there.
Politicians playing on peoples fears to enact ineffective and intrusive legislation that does nothing to curb dog bites and irresponsible ownership?...Nope no sense of humor there.
Bullies who think it's fun to verbally harrass and threatened responsible dog owners based on what they think is a 'pit bull'?...Nope no sense of humor there either.
(You seem to think bullying in particular is funny. Trying reading some of these accounts and see if you still find it funny)
Ignoring for now the permanent disfiguration that a bite from any dog breed can inflict upon a child let me say that in the 2 daily reports I get from google with the keywords 'pitbull attack' and 'dog attack' to the best of my knowledge I have never seen any report of crushed windpipes.
Perhaps if I included the term 'strawman' I might get some results.
Well given the hysteria it would not suprise me if they tried to sterilize pit owners too. After all what kind of person could possibly want to own this American iconic breed known, prior to the mass hysteria, for its playfulness, smile, independance, tenacity, and tolerance.
Did you see the many pictures of happy, gentle rescued pits and pit mixes out of NOLA?
It seems clear from the story that the owner was not a poster child of humanity.
What aside from the desire to pin this on the bad nature of pits would lead anyone to look further than the obviously excellent source of this attack, a creepy owner.
No. But I did read of police shooting packs of pit bulls and pit mixes who were attacking people, and other dogs, and eating cadavers.
I have no use for pit bulls, a dog whose jaws can kill another dog or a child, or even some adults with one snap. They are time bombs, AFAIC, the only question being when will they go off?
With all the breeds out there which are proven to be non-threatening and can't kill with one snap of its jaws, why on earth would anybody choose a pit bull?
Even a creepy owner couldn't get my Bichon Frises to attack and maul a nine-year old kid.
Shoot a person with a .22 and he will likely live through it.
A shot from a .45 is nearly always fatal.
It's a macho thing. Some people can't afford a Corvette.
Key word "my" Bichon Frisees. Not any Bichon Frisees.
So you are a good owner. I would expect no less. Your dogs in another's hands, that's a hypothetical for which your claims of certainty leave me unconvinced.
Lots of breeds not just Pits are .45's. Do you want to ban them all?
Can you add drunk and disorderly to the charges?
I can't wait until we sterilize all irresponsible dog owners.
I knew it wouldn't take long. You just don't have any defense for these dogs. That's my opinion. If one's in my neighborhood and gets loose, and it gives me a half second of doubt as to its intentions to be violent, and it's on or near my property, it's 9mm Black Talon hollowpoint justice time. It is my personal opinion that these dogs cannot be trusted, and too many owners cannot be trusted to be responsible. I will err on the side of safety for my children.
Can you add drunk and disorderly to the charges?
***
As I said, my knowledge of criminal law is minute, so something like that would be up to the legal minds in the DA's office. Personally, I would add as many charges as I could, preferably felony charges -- try to get that sentence upped to more than a 2-year max. I don't know about the jurisdiction where this incident occurred -- but where I live, drunk and disorderly is generally a misdemeanor -- misdemeanors don't do anything to increase the severity of the sentence.
Just seems to me that a possible two years maximum sentence is not enough for this heartless clod.
And the laws that attempt to do so are based on looks, much like 'assault rifles'. The bans go way too far (and end up in idiocy), if you accept the premise that the specific breed should be banned.
PBTs make me nervous, and no, I don't trust them. But, the solutions being proposed are rotten.
My point, which you seemed to have completely missed, is that the laws are based on LOOKS and appearances. This is beyond ridiculous.
