If a driver with .02 is judged by a cop of being unable to drive, this judgment needs to be applicable when a fully able driver comes in with above those .08's.
Since these differences of .06 are a low limit, a upper limit of .14 should then be the upper most barrier for the hardiest drivers.

If you have even 1 drink of Alcohol, don't drive a vehicle.
Good advice in a police state, but dumb advice if you allow greater impairments to be legal, like being over 70, under 20. a little tired at the end of the workday, listening to the radio, chatting with a passenger, etc.
Don't buy the MADD propaganda.

ALL the roadside exercises, (there are not legally tests) are only 60% accurate. Would anyone get on an airplane that was only 60% functional? If you had a source, that would be even more appreciated. I would guess that various studies would show varying accuracy for these roadside tests, too.
Nevertheless, I am sure you are right that these tests are not reliable. An airplane is one comparison. Perhaps a more telling one would be to ask whether you would consent to expensive medical procedures-- as expensive as a DWI conviction, say-- on the basis of gymnastics tests eyeballed not by a doctor by a community-college educated technician, a technician with the equivalent of a weekend seminar's education on interpreting the tests. Sound reasonable to you? Does it sound any better when we are discussing criminal conviction?
