The border search exception permits searches at the border of the United States "or its functional equivalent." United States v. Montoya De Hernandez, 473 U.S. 531, 538 (1985). The idea here is that the United States as a sovereign has a right to inspect stuff entering or exiting the country as a way of protecting its sovereign interests, and that the Fourth Amendment permits such searches.

Wouldn't the spying that Bush has authorized be considered a border search?

The MediaMatters/Soros lie you're pimping suggests the Clinton EO allows for warrant-less searches outside of the US, not within.

Since when did US courts issue warrants for searches on foreign soil? Since when do our courts have international jurisdiction? Why would Clinton need to issue this EO if it didn't apply to "American persons"?

For anybody following this, pay attention. This is what they do here. They invade threads when the traffic dies down, when they're going to meet as little resistance as possible... and they pollute them with their lies, distortions and propaganda. When nobody responds, it gives the appearance that they've won the debate, when in actuality, they're getting the last word on a dead thread because there's nobody left to respond.

You should all check out the site, the "news" stories they run and the user comments. This is the enemy. This is how they talk, how they act, how they think. And unlike the bulk of militant Muslims, these bastards are in our own backyard.

Anybody who links to or supports anything on mediamatters/thinkprogress is a troll, and I say that with 100% certainty. If you check the site for yourself, you'll see there's no other possibility. These sites are the worst of the worst.

Did you read your link? Because it doesn't say anything about the spying story, let alone "expose" a liberal response to charges that Clinton and Carter did the same thing.
