Lincoln set the precedent. The only way your going to win this one is to get the Democrats to win an election on this issue. LOL!

Indeed he did. And his actions as it pertains to habeas corpus were overturned in Ex Parte Milligan in 1866. His action of declaring war, and starting one in effect, without Congressional approval were inexcusable.
