This loss will make the ACLU show their true colors more strongly. See tagline.

Don't ever forget -- judges (and most politicians) are the spawn of lawyers.

Thank you for the post. I read the courts opinion and it warmed my heart. "The ACLU ...... does constitute a reasonable person."

I love it. Merry Christmas to you and yours.

...and all of their lawyers sent to one of our nonexistent prisons in Croatia or somewhere...

Unfortunately, lawyers are a dime a dozen (despite the outrageous fees they charge). This is especially true for Leftist lawyers, who appear in droves fully formed from the womb.

And if Jefferson used that phrase in a letter, so what?

Indeed. Jefferson was in France when the Constitution was written, so even in his own day he was hardly an expert on it. Then, despite all his utterings about small government, he was the first president to massively expand the powers of the federal government beyond what the Constitution provided. He also allowed the federal courts to grab far more power than the Constitution gave them, and we've been paying the price ever since.

What good are these victories if no one but FReepers know about it?

Trust me. This one will go up to the Supreme Court. It has to, because now there are very different judicial interpretations of the establishment clause in use in different areas of the country. Once it gets to the Supreme Court, everyone who pays any attention to real news in this country will hear about it.

Jefferson himself did a lot of things that would violate the wall doctrine, so it is clear he himself didn't belive in it.

Such as? I'm not disagreeing, I'm just curious about what actions you had in mind.

And why is it so hard to believe?

Short answer:

Because the gauge in my head that measures faith in the people who are sworn to correctly interpret the Constitution is bouncing on empty.

Long answer:

Read the rest of this thread and all the other threads that have ever been on FR about activist judges, ACLU scum, etc.

"I freely admit the right of a nation to change its political principles and constitution at will." --Thomas Jefferson to the Earl of Buchan, 1803.

There are such things as Constitutional principles.

I don't believe that the words "system of checks and balances" ever appear in the Constitution either, but it does not make the principle any less Constitutional.

I am very happy that a judge made the correct decision on the constitution, not allowing leftwing judges continue their assault on the Constituion and the first ammendment. May the good Lord bless this judge and remove the left wing activists from power before they destroy our constitution and make America into but one more neo European socialist nation with a stagnant economy and dumb downed citizens; which explains their inability to deal with the Islamic terrorists and hostile takeover of Italy by violence.

I mean, I'm in Southern California, and believe me- a fence does nothing. There are so many people from Mexico here, it doesn't matter if more get halted. It's too late.

An establishment of religion is a church, synagogue. In otherwords, the government will not interfere with the inner workings of the church

No. It means that there will be no established, official, Federally sanctioned religion. No Church of America, as was the case in England with the C of E.

The Religious Wars were not far in the past for the Founders, and they didn't want that sort of thing starting here. In 1776, the Spanish Inquisition was still around. It wasn't abolished until Napoleon took over Spain.
