Internet trash talk results in lawsuit; Medina man sues over chatroom posts
Cleveland Plain Dealer ^ | Tuesday, January 17, 2006 | Rena A. Koontz, Plain Dealer Reporter

Medina- George Gillespie knows Bob Charpentier and Mike Marlowe only from an America Online chatroom, where they have traded insults electronically for five years.

But face-to-face meetings in Medina County Common Pleas Court may be in their futures.

Gillespie, of Medina, sued the two men - one from Oregon and the other from Alabama - saying that they insulted and harassed him to the point that "no reasonable man could be expected to endure it."

Gillespie, 52, is seeking a $25,000 judgment. He also sued America Online Inc., charging that the Internet service provider was negligent in not canceling Charpentier's and Marlowe's accounts after he filed complaints against them.

A hearing is scheduled for Jan. 31.

Let me take a stab at where this is headed. This guy will be represented by a LAWYER. The other guys will be represeted by a LAWYER. There will be 1,000's of other cases like this with this new rule about anonomous postings offending people. Each case will require minimum of 2..you guessed it..LAWYERS.

This will be a total drag on the court system and will make a lot of money for..one last time...LAWYERS!

More than amazing, it's frightening. If the courts decide to intervene on the behalf of a participant in a flame war, that's the end.

May I say that is a fine article you have posted and that you are a great American and an oustanding Freeper. (I hope you find the previous sentence non-offensive). - :o)

Seriously, I will be interested in following this and how much liberal interest "rights" groups (ACLU, etc.) take a stand in this.

And who does the complainant allege forced him into that chatroom to take the alleged abuse till he could stand it no more?

no reasonable man could be expected to endure it.

I wish I knew what they said. I could use some extra ammo.

Further, we must assume he was chained to his keyboard, not allowed to log off and limited to only one website.

And this knucklehead feels A-O-hell has some sort of duty to tombstone paying customers?

He may as well sue his computer manufacturer and ISP. And the person who taught him how to use the computer. Heck, throw in the operating system manufacturer. And the power company that provides electricity to his home or any other place he signed on for the abuse. Not to mention the company that made the desk on which his PC sits, and the chair maker.

Come to think of it, he should sue God for giving him a life that could be so harshly treated.

He could have simply changed chat rooms, I'm sure there's a group on AOL that discusses open-toed shoes and frilly lingerie.

The original report of this ongoing story stated that these two men (being sued) physically went to the plaintiff's home and photographed it, then they posted the pics online. So why was the jerk giving out his personal info in a chatroom? Furthermore..what's the ISP got to do with it? Why sue AOhell, they don't care who insults who unless someone is gay and gets offended. AOhell is all about gays and no one else. Other than that, this whole story is stupid from the get-go.

Greetings jennyp:

To grease the rails for this idea, Sen. Arlen Specter, a Pennsylvania Republican, and the section's other sponsors slipped it into an unrelated, must-pass bill to fund the Department of Justice.

Senator Spector, the RINO gift which keeps on giving.

Perhaps Arnie might find this anonymous posting offensive?

Cheers,

If he can demonstrate A-O-Hell failed to live up to their obligations under the terms of service agreement, the knucklehead can expect a ruling in his favor.
