But the Libby team seems to be preparing an argument
that there was no investigation. How can one impede
something not actually in progress?

The whole point of the Fitzmess seems to have been
to generate and prosecute faulty recollections.
If the defense has a case that this is a frivolous
malicious prosecution, the jury needs to hear that.

Only the judge decides what is relevant for the jury to hear.

If the indictment is narrow and the judge declares it is valid, the jury will not be called on to second guess that.

What would it take to empanel a new grand jury to investigate this "Fitzmas investigation"?

Whatever it is,it would be worth starting a petition drive.

It would be sweet justice to call Fitz before a grand jury and question him under oath for 30 days straight.

You asked for comments? From the get-go the case against Scooter Libby was weak, IMHO. I agree it's getting weaker by the day as details unravel. Fitzpatrick cannot give up and drop the charges now, however, his career is on the line. And I don't think the charges will be so weak that a Motion to Dismiss will succeed before trial.

The only way a Dismissal becomes likely is if one of the reporters called as a witness refuses to testify, and is an essential witness. In that case, Dismissal of the charges is a sanction the court can and should apply.

If Mr. Libby is in financial trouble, let him get Marc Rich to finance his legal defense.

Yes, Scooter Libby represented Marc Rich in Rich's tax fraud case with the IRS. There's a side of me that really doesn't give a sh!t if Libby gets run through the legal system for the next 50 years. How this kind of smarmy pr!ck ended up as the VP's chief of staff is beyond me.
