The new stamp ($7) required to hunt certain types of birds.

It has only been required since Sept. 1, 2005 and TPWD does not even fine someone for not having it. Right now all that is issued is a warning since the State did a very poor job of publicizing it. Fines will be issued starting Sept. 2006.

Here's Texas Parks and Wildlife's marching orders for 43.652... Maybe the citing officer was grabbing at straws, or wrote a violation (numerical description) in error, or my search of the WWW turned up the wrong department's sec. 43.652?

Sec. 43.652. NOTICE; VERIFICATION. (a) Not later than the
third day before the first date a landowner or a landowner's agent
or lessee intends to hunt depredating deer under this subchapter,
the landowner, agent, or lessee must notify in writing the game
warden or other department employee assigned to the area in which
the landowner's property is located of the landowner's, agent's, or
lessee's intent.

(b) Not later than the next business day after the date of
notification, the game warden or other department employee shall
contact the office of the Texas Cooperative Extension serving the
area in which the landowner's property is located to verify that the
landowner's property is typically used to plant a crop that is
susceptible to damage caused by depredating deer.

(c) Not later than the second business day after the game
warden or other department employee contacts the Texas Cooperative
Extension under Subsection (b), the game warden or employee shall
notify the landowner, agent, or lessee if the landowner, agent, or
lessee is prohibited from hunting deer under this subchapter. The
game warden or other department employee may prohibit a landowner,
agent, or lessee from hunting deer under this subchapter only if the
Texas Cooperative Extension office contacted under Subsection (b)
notifies the game warden or other department employee that the
landowner's property is not typically used to plant a crop that is
susceptible to damage caused by depredating deer.

This is the stamp requirement that was violated by VP Cheney. However, I failed to link sec. 43.652 with it.

Hunting Stamp Endorsements Effective September 1, 2005, the turkey, white-winged dove, and waterfowl stamp endorsements will be replaced by an upland game bird stamp endorsement and a migratory game bird stamp endorsement.

SPECIAL NOTE: No STATE stamp endorsement is required for anyone under 17 years of age (resident or non-resident), holders of Lifetime Resident Combination, or Lifetime Resident Hunting Licenses.

Archery Stamp Endorsement (Type 135): $7 Required to hunt deer or turkey during an Archery-Only open season.

Texas Migratory Game Bird Stamp Endorsement (Type 168): $7 Required to hunt any migratory game bird (waterfowl, coot, rail, gallinule, snipe, dove, sandhill crane, and woodcock). A valid Federal Duck Stamp and HIP Certification are also required of waterfowl hunters 16 years of age or older.

Upland Game Bird Stamp Endorsement (Type 167): $7 Required to hunt turkey, pheasant, quail, lesser prairie chicken, or chachalaca. Non-residents who purchase the Non-resident Spring Turkey License are exempt from this stamp endorsement requirement. May not be used to hunt turkey with Non-resident Special Hunting License (Type 107) or Non-resident 5-Day Special Hunting License (Type 157).

Federal Migratory Bird Hunting and Conservation Stamp ("Duck Stamp"): $15 Required for all waterfowl hunters 16 years of age or older; available at most U.S. Post Offices, all TPWD Law Enforcement offices, and Austin HQ. The stamp must be signed on its face by the person using it. A valid hunting license, HIP Certification, and a valid Texas Migratory Game Bird Stamp fee are also required.
