How can you have a plea deal where the accused pleads not guilty and the state says, "Well, ok, we'll accept your not guilty plea and we won't prosecute if you are a good boy for 18mos, after which we will drop the charge and your not guilty plea."What am I missing? How can you charge someone, allow them to plead not guilty and then not pursue the case?
In Florida, it's called a withhold of adjudication. And it's not at all uncommon. You plead not guilty -- which means you're telling the state to prove it at trial -- and the state comes back and says, OK, if you do X (anger management, stay off drugs for 18 months), we'll drop the charges, you'll get a withhold of adjudication and we'll let you expunge your record at the end.

People react differently to drugs. I had abdominal surgery and was taking four Hydrocodone tablets every four hours for at least a month.
I didn't feel good at all.
And I certainly didn't get addicted.
A few months later when I had a really bad headache, I took one of the two remaining pills. It cured the headache and sent me into euphoria.
I still have the remaining one, although it's probably lost all it's effectiveness.

Because this DA had a very weak case. A face saving deal. That's probably most of it. Plus, the DA would have to prove "doctor shopping" in trial, which would mean he'd have to prove intent. And, I would think the DA might have some difficulty getting testimony from doctors against Rush, and then he'd have to get a jury to find Rush guilty. Rush probably agreed to this deal because he didn't want his whole personal life smeared, either.

I know I will get all sorts of negative feed back, but what the Hell. Let's all admit it, Rush was breaking some law. If he wasn't he wouldn't have gone into rehab twice. Don't you guys remember how much he was criticizing Clinton for not releasing his medical records, but when it came to his medical records, he used Roy Black to do his best to keep them out of the prosecutors hands. I know some will argue that Clinton was the president, and Rush is a entertainer, but you can't have it both ways. My guess, and I can be wrong, I feel that Rush just has an addiction and does not have any back problems as he claims. I don't play golf, but I can imagine that playing golf involves allot of back movement. If I am not mistaken Rush plays allot of golf. If all of these charges are phony then how come Rush has not sued the National Enquirer and his former house keepers who made these allegations. I will be the first to apologize if someone can give me exact details to counter my assumptions.

While it would have been very satisfying to see Rush give everyone the bird and insist on a trial, I understand the hesitation to place his life in the hands of a Florida jury. Also, who knows how long the DA could have continued "investigating"?

He sent back supportive reports of Stalin's Soviet Russia to the USA. Nary a word about the two million souls who died through criminal negligence, gulags and plain murder.

Come on Tiger, tell me how I don't know the first thing about this case. When Rush was first accused of these charges he took Roy's advice and was very sketchy on the details. Then he comes out on a Friday to announce that he is going into rehab for a second time to battle his addiction to prescription drugs. Tell me what I am missing?
