ARTICLE SNIPPET: "Izhar ul-Haque was yesterday granted an expedited preliminary hearing in the court.
Ul-Haque is charged with receiving training from a terrorist organisation in Pakistan during January 2003, a recently created offence that carries a maximum sentence of 25 years' jail.
He is challenging the constitutional right of the Commonwealth to extend the offence overseas, and his lawyers want to appeal directly from the Supreme Court to the High Court to argue the point.
The acting Chief Justice, William Gummow, set the preliminary hearing date for August 4, which is only a week after Ul-Haque is due to appear in the Court of Criminal Appeal on the same issue and other legal arguments.
The dual Australian-Pakistan citizen is yet to be tried on the charge, based on his attendance at a camp in Pakistan run by Lashkar-e-Toiba - "the Army of the Pure and Righteous".
He was there for three weeks when he was 19.
The Government says the group is trying to oust India from the disputed region of Kashmir by killing Indian soldiers, but it was not listed by Australia as a terrorist group until November 2003.
Ul-Haque had returned to Australia nine months earlier.
His notebooks were seized by customs at Sydney Airport and allegedly referred to rocket launchers, land mines, machineguns, and becoming a martyr in the struggle for Kashmir."
