You forget - the Courts decided that he exceeded his authority by deciding this issue. He has to have a law passed by Congress.
And if this doesn't motivate Conservatives to keep a GOP President and Senate in order to get constructionist judges, I don't know what will.

I realize that. That's why I said wait until after the election. If dems gained control of Congress they would impeach him for this action. But if Republicans retain control, it seems he could claim that it is within his power to establish rules for the Military to abide by in disposing of prisoners of war and that it involves matters of national security. Not an easy maneuver since Republicans are fairly spineless but I seriously can't see very many Republicans voting for impeachment over this except McCain and few others.
