I'd like to see the reasoning of this.
Though the Constitution says: "no Person holding any Office under the United States, shall be a Member of either House during his Continuance in Office. "
I don't think that has ever applied to military office.
That his duty is as a judge is constitutionally irrelevant.
It is only the pipsqueek's holding of a military office that can be disputed, unless there is some statute.

Pelosi and Rangel are spooked by the overnight polls. They wanted an anti-Chavez sound bite, because the public is outraged at Chavez. They don't want the folks to fuind out that they have been saying the exact same things.
Too late for them, however. Rush spent all of today digging up soundbites from democrats which sounded just like Chavez. HA!
