Court asked to revive suit over tuition for illegal immigrants

An attorney for a group of students at Kansas colleges asked a federal appeals court Wednesday to revive their lawsuit challenging a 2004 state law granting in-state tuition to some illegal immigrants.

A trial judge in Kansas had dismissed the lawsuit, saying the students did not face a "concrete and imminent" injury. The students appealed to a three-judge panel of the Denver-based 10th Circuit Court of Appeals.

The plaintiffs are U.S. citizens from outside Kansas paying out-of-state tuition to attend schools there. Their suit claims the state is violating federal law by offering some illegal immigrants a benefit that some U.S. citizens cannot get.

The case is being closely watched by several national organizations who say the outcome could affect similar laws in eight other states: California, Illinois, New Mexico, New York, Oklahoma, Texas, Utah and Washington.

Every student who is paying out of state tuition in a state that grants illegals in-state tuition should sue. This is an equal-protection issue that should not be allowed to stand. The state legislatures have made the interests of illegal immigrants more important than the interests of U.S. citizens who are not breaking the law. The least we can expect of our government is that it put our rights and privileges first, because other countries certainly aren't going to. That is the purpose of our government.

This is nuts,an "out of state" American citizen has to pay more then an "out of country" illegal alien to attend college in a number of states.It's time for another revolution !!!

Any judge that would deny that out-of-state tuition rates are not a "concrete and imminent" injury, has been completely out of touch for the past 10 years. There's no more "clear and present" danger than facing the prospect of paying $14,000 a semester for lowly State colleges.
