Joan K Irion of the Fourth Appellate District (San Diego area) was appointed by Gov Grey Davis first in 2000 and then to the appellate level in 2003. She concurred that discounts to Baby Boomers do not violate civil rights or unfair competition laws. See "Boomer suits go bust"

Art W McKinster of the Fourth Appellate District (San Diego area) wrote, "Just as the act of seeking an injunction maliciously and without probable cause is a tort, so too is the act of seeking and obtaining an injunction to enforce an unconstitutional ordinance.” This was regarding San Bernardino’s The Flesh Club, an adult establishment, and the city's attempt to halt the topless dancing.
