the difference between science and philosophy

I confess I do not know where you are going with this argument. Are you saying that Judge Jones was unphilosophical, unlawful, unscientific? Please elucidate.

And he also sells poison milk to schoolchildren.

Judge Jones thinks he is issuing a judgment regarding science, when in fact all he is doing is issuing an opinion regarding a philosophy of history that assumes the name "science" for itself. He apparently also has not the slightest idea what is guaranteed by our Constitution. There is absolutely nothing in that document to prevent anyone from discussing intelligent design even from a religious standpoint in a scientific, public, academic context.
