You are correct. I would bet if a person came in who the company suspected was an illegal, but the person had a SSN and drivers liscence, the company could be sued for NOT hiring them because of discrimination.

Just like teachers are forbidden to check the facts on any more then 2% of free lunch applications. 98% of those who apply can not be checked out.
