What the judge is saying is that reality has no place in the court room. It does not matter a hill of beans that white jury's are fair, what matters is the political spin, or the perception of the African-American.
Nifong like wise was not concerned about the reality of the situation, he like Judge Cohn, are more preoccupied with the spin, or perception of reality in African-Americans. Its a form of racism where they do not expect African-Americans to be intelligent enough to see the reality of the situation. How did someone put it, "the racism of low expectations"? Either White jurors can be fair or not, or the accused were rapists or not. Playing into a racist spin, like the Federal Judge Cohn, or like Nifong does, makes the concept of justice a loser.
