Bar Files Complaint Against Duke D.A.

The North Carolina bar filed an ethics complaint Thursday against the prosecutor in the Duke lacrosse case, accusing him of breaking four rules of professional conduct when speaking to the reporters about the sensational case. The punishment for ethics violations can range from admonishment to disbarment.

Among the rules District Attorney Mike Nifong was accused of violating was a prohibition against making comments "that have a substantial likelihood of heightening public comdemnation of the accuser."

In a statement, the bar said it opened a case against Nifong in March 30, a little more than two weeks after the party where a 28-year-old student at North Carolina Central University hired to perform as a stripper said she was raped.

Nifong did not immediately return a call for comment.

Nor did defense attorney Joseph Cheshire, who represents one of the three lacrosse players charged with sexual offense and kidnapping.

Last week, Nifong dropped the rape charges against the three athletes after the stripper wavered in her story.

Guess what.....it'll be a long time before any "action" happens at the Bar level. They often go on for a couple of years.

This one has more news in it than the earlier posts.

So, they have been proceeding quietly for some time. I would guess there are several reasons for making the proceeding public at this time. The most obvious is that Nifong was recently exposed as conspiring to conceal exculpator evidence from the defence and lying to the judge about it.

I also would guess that this might be added as an additional charge to the earlier ones. I don't know what the rules are in these proceedings, but presumably it would be possible to open additional charges as new discoveries are made.

On the other thread, you can read the bar association guidelines. The word is 'accused', not 'accuser.' The AP is a typo.

He definitely deserves admonishment for those statements. He deserves disbarment for malicious prosecution.

Disbarment should only be the beginning for this evil man. He (and the lying accuser) should be subject to the same penalties that the accused would have suffered if they had been convicted of these false crimes.

I think the bar is giving a hint to the judge to file contempt charges against him for the DNA lies he told.

Looks like he's being disciplined for running off at the mouth and prejudicing the accused in the press.

This should be just the beginning. Let's hope an investigation on Federal level will begin.
He should be disbarred and the 3 young LC players should sue him for millions. I am sure her has insurance policies that will pay off.

Maybe not - didn't one of the bloggers sit next to the guy from AP at the last hearing? The AP guy was CLUELESS as to the facts of the case. I think that the Durham AP stringer probably has no idea what is going on here.

They were copying verbatim from the ethics guidlines. AP is such a slimeball organization that I wouldn't put it past them to deliberately switch words, but since they've stopped calling the accuser a dancer and started calling her a stripper, it gives me mental whiplash to think they'd doctor publicly available guidelines deliberately to make them the opposite of what they are and insinuate Nifong insulted the accuser. I'm still thinking innocent mistake.

That is NOT what the complaint said.
