That being said, the woman is foolish not to have joined HSLDA or another group with prepaid legal counsel available. She and others like her may have been lulled into a lack of vigilance by the fact that Utah is a politically conservative state where homeschooling has been legal for a decade. However, like many conservative areas, there is something of what has been labeled “red state fascism” in place, where petty authoritarians like this judge are willing to abuse their authority, not unlike the Utah state trooper who tazed a motorist a few weeks ago merely for not respecting his “authoritah”. The "law 'n' order" mentality can morph into a petty tyranny as much as can the liberal nanny state advocates like social workers, MADD types, and health Nazis.

Though true. I'm not sure that would have changed this situation.

There are those of us who do not join the HSLDA - I am one of them. I disagree with some of the things that they are proponents of, and I also have read enough horror stories about how the HSLDA uses cases for the "greater good of all homeschoolers" rather than necessarily for the good of the family involved. Generally, those things may be the same, but not always. And if you sign their paperwork, you agree to allow them to represent you as they see fit, not according to what you believe is best for your family.

ALWAYS the very first thing a parent contemplating home schooling needs to do. They know the law, can cite the law - Supreme Court Law that allows for home schooling, and they will take care of legal fees...

the gendarmes don't usually mess with parents who show they are a member of the HSLDA
