Doesn’t the non powered craft have the right of way?
was there any drinking? that’d be the only explanation for charging the sailboat owner.
we had a man parking his boat trailer and got tee boned by an old lady who died at the scene. anyway even though it was her fault, because he was drunk he got charged with vehicular manslaughter.
absolutely correct. the speed boat should yield to the sail boat. Both boats should have had their running lights on since it was dark.
Not if you are a big wig on in the sheriffs office.
Under normal conditions a sail boat has the right of way. Unless of course it gets in the way of say a super tanker which takes a mile or 5 to stop and a half mile to turn.
Then maybe the sailboat has the right of way but it also will sink.
Yes, a sailboat, under sail, has the right of way. If it was operating under its engine power than the rules are different. Also, it must have its navigation lights on and so should the power boat.
