Is U.S. Bioterror Attack Just A Matter of Time?

The overriding question is whether the U.S. is “ready” for a bioterror attack. The answer could well rely on the “other” question of what bio-agent and what’s the source? In 1991, 40,000 Russian scientists dispersed throughout the World, with knowledge of what the U.S.S.R. was doing in chemical and biological weapons. The question is to whom did they sell their knowledge? Some believe former Soviet scientists sold technology to countries like Iran, Syria, and North Korea. Lurking is the spectre of al-Qaeda, a group that the Pentagon says continues to pursue biological weapons.

Another scenario is an outbreak of a pandemic. How would the U.S. deal with an infectious disease outbreak? The picture, despite reassurances, is not pretty. Until now, the U.S. has experienced two major biological attacks.

In 1984, the Bhagwan Shree Rajneesh and his followers attempted to take over the town of the Dalles, Oregon by contaminating salad bars in the town. In 2001, there was the as yet unsolved mystery of the anthrax letters that killed five people.

But the question of bioterrorism extends to potential threats against our food supply and our clean water resources. It also extends to the threat of outbreaks of diseases in our animals populations. Here, the concern are diseases that attack animals but that can jump to humans. These are referred to as zoonotic diseases. The World Health Organization defines zonnotic diseases as:

If ‘cash is king,’ then Middle East coffers are irresistibly enticing. During a recent tour of Saudi Arabia and the Gulf states , Deputy Treasury Secretary Robert Kimmitt applauded the ‘growing role’ of Arab banks in the U.S. economy. Treasury is seeking buyers for its newly acquired bailout assets because more than $1 trillion in cash is urgently needed to rescue the largest U.S. banks.

However, cash from the Arabian Gulf comes with a vital string attached: Islamic banking, erroneously viewed as an ancient practice. In fact, Islamic banking is a newly invented institution: ‘Neither classical nor medieval Islamic civilization featured banks in the modern sense, let alone ‘Islamic’ banks,’ notes Timur Kuran, professor of economics and law at the University of Southern California . According to the Dinar Standard, ‘assets managed by Islamic banks are in excess of $700 billion - predominantly concentrated in the Middle East .’

Islamic banking took off in the 1970s, but was first concocted by Muslim Brotherhood founder Hassan al-Banna in the 1920s. The stated goal was to penetrate the Western finance system, corrupting it from within in hopes of creating a parallel system to re-establish a global Islamic empire governed by Islamic law (Shariah). Islamic rules of commerce (fiqh al-muamalat) forbid interest (riba) and investing in a prohibited (hara’am) enterprise. They also mandate tithes on wealth (zakat). However, the Koran fails to precisely define these concepts. Imams and ayatollahs differ, for example, on whether riba prohibits all interest or only usurious interest.

While the overhaul of American and Western banking regulations is urgent, Islamic banking cannot be the answer because Muslim clerics - not U.S. laws and regulators - make the rules. In 1969, the Saudis created the Organization of the Islamic Conference (OIC), which is now leading the charge for global expansion of Islamic banking and has established new regulatory, accounting and auditing organizations to govern such banks. Notably, the OIC’s charter is to ‘liberate Jerusalem and Al-Aqsa [mosque] from Zionist occupation.’

Not surprisingly, zakat from Islamic banks often funts terrorist groups like the Muslim Brotherhood’s Hamas. That organization’s agenda was exposed during the Dallas trial of The Holy Land Foundation, a Hamas front group and an American Muslim charity just convicted of terrorism crimes. Evidence of the charity’s true purpose included an 18-page ‘explanatory memorandum’ outlining its ‘strategic goal … that all their work in America is a kind of grand Jihad (holy war) in eliminating and destroying the Western civilization from within.’

Sharia financing forbids loans to entities labeled hara’am, such as industries that use alcohol, and to all Israeli businesses The Arab League Council established the boycott against Israel on December 2, 1945, (more than two years before creation of the Jewish state). The boycott prohibits all Arab states, companies and individuals from any financial or trade relations with Israel . Companies worldwide are blacklisted for doing business with Israel , as are companies doing business with boycotted firms. The OIC high commissioner for the boycott of Israel coordinates the efforts of its 57 member states from the Central Boycott Office in Damascus .

In response, the United States made it illegal for individuals or companies to cooperate with the Arab boycott. The law mandates reporting of boycott requests and imposes civil and criminal penalties against boycott participants. Arab boycott requests have risen sharply in tandem with the U.S. financial crisis and the rapid growth of Islamic banking. The Commerce Department’s Bureau of Industry and Security reported a 20 percent increase in Arab boycott requests overall from 2005 to 2006, and the Congressional Research Service reported 24 boycott requests to U.S. companies in fiscal 2007 from little Bahrain alone.

On April 5, 2006, Congress unanimously condemned Saudi Arabia for its continued enforcement of the boycott - which violated commitments the Saudis made to the World Trade Organization in 2005. Nonetheless, last August Saudi Arabia and other Gulf states threatened to boycott Nissan, which aired a commercial on Israeli television promoting a fuel-efficient car, and demanded the Japanese carmaker’s apology. Not a word from Washington .

Instead, the Treasury Department, hungry for petrodollars, is holding seminars to promote Islamic banking and U.S. taxpayers are footing the bill. This practice must stop. Islamic banking corrupts our financial system, enables the illegal Arab economic boycott of Israel and entangles government with Islam in violation of the First Amendment’s Establishment Clause.

VIN Switching: The Ultimate Alias for Auto Theft.

Sarasota used car dealer Sergiy Zheleznyak had obtained 36 phony car titles for
nonexistant vehicles, late model vehicles such as six 2009 Mercedes Benz sedans, two
2008 BMW’s, and an assortment of 2008 and 2009 Honda Accords, Accra’s and Toyota’s.
Sergiy Zheleznyak runs MS Auto a small used car/body shop in North Port Fl, there is no
possible way he could have actually paid cash for almost $1 Million in late model luxury
vehicles.

Sergiy Zheleznyak was obtaining the phony titles on the non-existant vehicles from the
Sarasota County Tag office for his associate Alexksandr Mikhaylov in New York City. “Auto
Body Repairs and Painting” MS Auto is also listed as body shop repairs and painting in
local phone listings.

Sergiy Zheleznyak, as MS Auto, was going to obtain $100 each for the phony titles from
Alexksandr Mikhaylov in New York City as Mr. Mikhaylov needed the new titles to ship
vehicles matching the description (stolen possibly) on the titles to Russia. All of the
supposed 36 vehicles that Sergiy Zheleznyak registered in Sarasota were new, full size
sedans, SUV’s and pick-up trucks with 5 to 50 miles listed on the odometer, with no lien
holders, free and clear, but of course they did not ever exist in Sarasota, on paper only, but
in New York City that is a different story.

VIN Switching: The Ultimate Alias for Auto Theft, a technique used by thieves to disguise
the identity of a stolen vehicle. They will replace the VIN on a stolen vehicle with a VIN
that is not associated with an active theft record. The vehicle thief will then try to resell the
stolen car to an unsuspecting customer, or ship the vehicle out of the country. In addition
to manually switching the VIN, some VIN switchers will also develop fraudulent titles and
registrations to go along with the vehicle.

It appears that Alexksandr Mikhaylov had a shopping list of possible stolen cars in New
York City that he needed phony titles from Sergiy Zheleznyak in Sarasota in order to ship
his cars out of the docks of New York and New Jersey, (past U.S. Customs and Border
Protection), to Russia and re-sell his $1 Million inventory.

In Miami Fl, we have used car dealer Ali Hassan Hammoud, who was arrested in July 2008
for attempting to steal $5.7 Million from the State of Florida. Ali Hassan Hammoud
operated his chop shop under the name of Germanco Auto Parts, also as Germanco Parts
Depot Inc, and as Germanco Auto Sales Inc, all linked to the 9741 NW 27th Ave address of
“Zamaiss Import Export Inc.” as seen in the story below. Ali Hassan Hammoud also
appears to be linked to a second Florida car business that appears to have been exporting
stolen used cars to Africa and selling the vehicles with altered VIN’s.

During the last 30 days I have receives phone calls from around the State of Florida in
regards to phony Bank Checks (Cashier Checks) that Ali Hassan Hammoud had written on
his “Zamaiss Import Export” account at Regions Bank to the tune of about $900,000, that
is not recoverable. The $900,000 was for cars, trucks and over the road vehicles for
shipment to the Middle East.

Hammoud, a native of Lebanon who lives in Miramar, was arrested Friday July 24th 2008
at Miami International Airport by FBI agents arrest as he was attempting to fly to Beirut.
Muslim used car dealer Ali Hassan Hammoud was able to steal $5.7 Million from the State
of Florida and wire transferred at least $3 Million to Beirut Lebanon (can you say
“Hezbollah”).

Hezbollah has been involved in the stolen car racket to support terrorism for years,
Hezbollah theft rings have stolen luxury cars in Canada and sent them to Lebanon for use
by senior Hezbollah officials.

On or about August 8th, 2008 I received a phone call from a Miami body shop owner who
claimed he had also been a victim of Ali Hassan Hammoud, Hammoud had used his State
of Florida used car license (with his approval) to purchase used cars from CoPart, but the
supposed Certified Checks that Ali Hassan Hammoud presented to CoPart for the vehicles
were forgeries and the Miami body shop owner is now on the hook for thousands of
dollars as it was his license used to purchase the cars.

Copart auctions used and salvage vehicles to auto parts dismantlers, rebuilders, used car
dealers, wrecking yards, and the public for insurance and rental car companies and
manufacturers. Ali Hassan Hammoud could not purchase used cars as a dealer in the State
of Florida as his license had been revoked, something about all those stolen car charges
and operating a Chop Shop.

Ali Hassan Hammoud was more than likely sending stolen vehicles out of the country after
switching the VIN’s from the Copart auction cars to the stolen cars and then via the Port of
Miami to the Middle East through his Zamaiss Import Export company.

Belgium Charges 6 in Terror Investigation By STEVEN ERLANGER, Published: December 12,
2008 PARIS — Authorities in Belgium charged 6 suspected extremists Friday with
membership in a terrorist group, as per the federal prosecutor’s office.

The six were among 14 people arrested in raids early Thursday, including a woman who
writes jihadist screeds on the Internet and three men the Belgian authorities said had just
returned from training camps along the Afghanistan-Pakistan border. One had “said
goodbye to his loved ones,” according to the Belgian federal prosecutor, Johan Delmulle,
leading to fears of an imminent suicide attack.

Lieve Pellens, spokeswoman for the prosecutor’s office, said in a telephone interview that
the six suspects charged Friday included the woman, Malika El Aroud. She said that the
other eight were released because a judge had determined that there was not enough
evidence to press charges.
The suspects charged Friday are all Belgian nationals and most are of Moroccan origin, Ms.
Pellens said. She said that they should be arraigned within five days.

Wednesday May 28th 2008 the Sarasota Herald Tribune reprinted a story from the NY
Times concerning and romanticizing Malika El Aroud a Belgium female “Islamic Blogger”
with blue slippers monogrammed in gold SEXY, she advocates the violent over through of
the USA, the UK and every other “non-believer” Western Country, quote “She calls herself a
female holy warrior for Al-Qaida” the same al-Qaida that Osama ben-Laden admits was
responsible for the attacks on September 11th 2001 in the USA.

Malika El Arouud’s first husband had a part in the execution of the beginning of the
9/11/01 attacks, in early 2001 she followed her husband Abdessater Dahmane to
Afghanistan as he trained at an al-Qaida camp, she was installed in a camp for foreign
women in Jalalabad, her husband became ready for his mission and two days before the
attacks of Sept. 11, 2001, carried out a suicide bombing in Afghanistan that killed the
anti-Taliban resistance leader Ahmed Shah Massoud at the behest of Osama bin Laden.

Massoud was the target of a suicide attack which occurred at Khwaja Bahauddin on
September 9, 2001. The attackers were two Arabs, Abdessater Dahmane and Bouraoui el-
Ouaer both Tunisians, Malika El Around’s husband Abdessater Dahmane was killed, and
she took to the Internet as the widow of a martyr (this woman is a terrorist).

The September 9, 2001 suicide bomb attack in which Dahmane and another man
assassinated Ahmed Shah Massoud, the legendary leader of the anti-Taliban Northern
Alliance in Afghanistan was a vital mission: Taliban support needed to be shored up in
anticipation of al Qaeda’s 9/11/01 attack on America. Dahmane and a fellow Tunisian,
Bouraoui el Ouaer, posing as television journalists arranged an interview with Massoud.

A bomb that had been hidden in the camera exploded. Dahmane, a Tunisian al Qaeda
recruit was, like his wife Malika El Around were/are devoted to Osama bin Laden. The same
scenario with a “supposed” interview with President Bush almost occured in Sarasota Fl on
9/11/01.

On September 11th 2001 at around 6:00 AM Longboat Key Fire Marshall Carroll
Mooneyhan was at the front desk of the Colony Beach & Tennis Resort in Sarasota Fl as
Bush prepared for his morning jog. From that vantage point, Mooneyhan overheard a
strange exchange between a Colony receptionist and security guard.

A van occupied by men of Middle Eastern descent had pulled up to the Colony stating they
had a “poolside” interview with the president, Mooneyhan said. The self-proclaimed
reporters then asked for a Secret Service agent by name. Guards from security relayed the
request to the receptionist, who had not heard of either the agent or plans for an
interview, Mooneyhan said. The receptionist gave the phone over to a nearby Secret
Service agent, who said the same thing: no one knew of an agent by that name or of any
poolside interview.

The agent told the occupants of the van to contact the president’s public relations office in
Washington, D. C., and turned them away from the premises, Mooneyhan said. Zaine
labdeen Ibrahim Omer called Sarasota police on Sept. 11, hours before Bush left town with
concerns about 3 Sudaneese men in town led by “Ghandi” who had made violent threats.”

Several hours before the alleged assassination attempt took place of President Bush on
9/11/01, Zaine labdeen Ibrahim Omer delivered his warning. Its right there in black and
white in the police report, which was taken at 4.07 AM on the morning of September 11.
The Sarasota police immediately called in Secret Service agents guarding the President,
who was spending the night at the Colony Beach & Tennis Resort, on Longboat Key, just
off Sarasota.

Within hours Secret Service agents were searching an apartment in Sarasota, where they
took a number of Sudanese men into custody (see complete Sarasota Police report) . They
arrested three occupants from Sudan; they were questioned for the next ten hours,
according to one, Fathel Rahman Omer. The Secret Service also raided a beauty supply
store in Sarasota, owned by one “Hakim,” who identified the mysterious “Ghandi” as a
member of the Sudanese People’s Liberation Army, itself closely allied with the Taliban
and Al Queda.

In a August 24th 2006 interview with CNN, Malika El Around she said “It’s easy for me to
describe the love my husband felt because I felt it myself,” she said. “Most Muslims love
Osama. It was he who helped the oppressed. It was he who stood up against the biggest
enemy in the world, the United States. We love him for that.” She remarried Moez
Garsalloui, a Tunisianin in 2005/2006 , and she and her new husband were convicted in
Switzerland for operating pro-al-Qaida Web sites.

Now, according to the Belgian authorities, she is a suspect in what they believe is a plot to
carry out attacks in Belgium. (this woman is a terrorist) “Vietnam is nothing compared to
what awaits you on our lands,” she wrote to a supposed Western audience in March about
wars in Iraq and Afghanistan. “Ask your mothers, your wives to order your coffins.” (this
woman is a terrorist).

Her new “husband” Moez Garsalloui, was detained last December with 13 others in what
the authorities suspected was a plot to free a convicted terrorist from prison and to launch
an attack in Brussels. But Belgian law required that they be released within 24 hours,
because no charges were brought and searches failed to turn up weapons, explosives or
incriminating documents, Moez Garsalloui has now dropped out of sight, on another al-
Qaeda venture.

Now, even as Malika El Aroud remains under constant surveillance, she is back home
rallying militants on her main Internet forum and collecting more than $1,100 a month in
government unemployment benefits. (this woman is a terrorist).

Perhaps the Sarasota Herald Tribune and the New York Times (which owns the Sarasota
Herald) could spend their journalistic efforts in helping to get websites such as Malika El
Aroud’s (which spew terrorist propaganda 24/7 with “Death to the West” at the fore front)
shut down and perhaps help prevent another 9/11.

Certain groups such as the “Jawa Report” and the “Internet Haganah” work very ward in
shutting down jihad websites like Malika El Aroud’s, she is the enemy, she is a terrorist,
she wants you and everyone of the non-believers to either convert to Islam or perish, it is
just that simple.

In the very short time that I have worked with major main stream newspapers in shutting
down terrorist websites nationwide we have obtained very positive results in Tampa Fl
Phoenix AZ, Boston MA and National Press with Fox News.

Sen. Joseph Lieberman has made public statements and requested that YouTube cancel
the numerous terror videos that show US soldiers shot or blown up by al-Qaeda in Iraq or
the Taliban in Afghanistan, YouTube shut down 80 such videos, but many more exist.Al-
Qaeda is winning the propaganda war on the Internet and the Sarasota Herald Tribune and
the New York Times need not help them along.

The lawyer, who recently praised the Mumbai terror attacks, urged all Muslims to reject traditional Christmas celebrations, claiming that they are forbidden by Allah.

The 41-year-old shocked Christians and even those of his own faith by branding yuletide festivities as “the pathway to hellfire”.

Choudary, who is chairman of the Society of Muslim Lawyers, ruled out all celebrations, including having a Christmas tree, decorating the house or eating turkey.

In its report to the American people in 2004, the 9/11 Commission warned that “the greatest danger of another catastrophic attack in the United States will materialize if the world’s most dangerous terrorists acquire the world’s most dangerous weapons.”

Congress heeded that warning in 2007 when it established the Commission on the Prevention of Weapons of Mass Destruction Proliferation and Terrorism. Republicans and Democrats alike recognize that stopping terrorists from obtaining nuclear and biological weapons must be an urgent national priority.

The mandate of our Commission is to build on the work of the 9/11 Commission and complete a critical task: to assess our nation’s progress in preventing the proliferation of weapons of mass destruction and terrorism, and to provide a roadmap to greater security with concrete recommendations for improvement.

We’re examining the government’s current policies and programs, identifying gaps in our government’s prevention strategy and recommending ways to close them when we issue our report in December.

Since May, we have interviewed over 200 experts inside and outside of government. We have met with counterterrorism and intelligence officials here at home and abroad who are working to stop proliferation and terrorism.

Seven years after the tragic events of September 11, 2001, the threat of a terrorist attack on the United States is still very real. We are not yet safe. There is more that can and must be done. The security of the United States – and the world – depends on it.

This could be a preview of what our economic situation could become.

The background of the posts is this: the government of Argentina allowed the public treasury to assume private company debt incurred in the 1980s and 1990s (possibly in fraudulent transactions). Sound familiar? The debt grew and grew, and when it became too burdensome in 2001, Argentina defaulted.

Overnight, the Argentine peso lost two thirds of its value (33 cents instead of one US dollar). The money supply collapsed. If you had $2000 in the bank, then the bank decided (I’m sure with the collusion of the government) that you actually had only $666 pesos, not $2000. The author insists that the banks (perhaps it was also the Argentine treasury, or the IMF, or someone else, in addition to the banks) stole 2/3 of the deposited money. I suppose that could be debated. With runs on the banks, no one gets all their money back immediately.

Eventually some of the accounts were settled, but in the meantime, there was a huge cash flow problem. People lost their jobs, crime skyrocketed, goods in the stores disappeared, mobs began to riot and loot with abandon, and no one was safe any more.

Charges: Men planned to fly model plane bomb into base

Two men from the East Jerusalem neighborhood of Isawiyah were indicted yesterday for planning to fly an explosive-packed model airplane into an army base near their home.

The indictment, issued by the Jerusalem District Court against Iyad Abid, 20, and Abdullah Abid, 21, states that they tried out the model airplane over the base, where it crashed. The indictment also states that the pair were planning to slam a tractor into an army jeep and abduct the soldiers in the jeep along with their weapons, to bargain for the release of members of Iyad Abid’s family who are serving life sentences in Israel.

mentioning similar networks in Brussels and Liege, the Belgian and French security forces moved to act against a suspected al-Qaeda cell. Some of the people named in the article are now charged with terrorism. Any connection?

A year and a half ago Moez Garsalloui and Malika El Aroud were found guilty of incitement in Switzerland. Both were let off with a slap on the wrist. They are now charged in Belgium with having organized an al-Qaeda cell which had a suicide bomber ready to go.


A French-Tunisian man appeared in court today on suspicions related to the French-Belgian investigation into the “Afghan networks connected to al-Qaeda”. The man was arrested Thursday in France.

The 28 year old is prosecuted for ‘criminal association in relation with a terrorist network’. He will appear before the judge who would decide whether he should stay in detention, as demanded by the prosecution.

The man is suspected of having assisted in the propaganda website Minbar, based in Belgium. the site was shut down by the authorities.

The site extolled al-Qaeda, delivered practical information for young candidates about taking part in Jihad, or to possible sponsors to support the goal, according to a judicial source.

The man admitted that he worked as a moderator for the site, but denies that he had an active role in the departure of jihadists to Afghanistan.

At least 8 people, six of whom are Belgians and two French, had used the site to prepare for their departure to Afghanistan.

The man, who is married and lives in Grenoble, was arrested Thursday in this city. Another man was arrested in Amiens and was placed in temporary detention in this case. He was freed in the meantime.

Fourteen people, suspected of belonging to an al-Qaeda network, were arrested Thursday in the scope of the same investigation in Brussels and Liege. Among them one man who appeared to be on the point of committing a suicide attack.

Six of them, five men and one woman, were accused Friday of membership in a terrorist group and placed in detention.

Among them was also Malika El Aroud, the widow of the man who murdered commander Massoud on September 9th, 2001, and her second husband, Moez Garsalloui (Garsallaoui), the central figure of the group which was dismantled and the owner of the Minbar website.


The Italian anti-terrorism unit of the police is investigating a possible link between two Belgian, among them an imam, who was arrested in Italy a month ago on charges of illegal immigration and the suspects who were arrested for possible membership in al-Qaeda, reports Italian news agency Ansa.

Imam Bassam Ayachi and a Belgian citizen were arrested on November 11th in the port city of Bari on charges of illegal immigration. Three Palestinians and two Syrians were found in their vehicle, which came from Greece. In his interrogation the imam made no secret of his admiration for Mohammed Atta, leader of the 9/11 attacks. He had named his six year old son after him. His son was with him at the time of his arrest and was placed in an institution, according to Ansa.

The magistrate tasked with the investigation, Roberto Rossi, and the Belgian embassy refused to comment further about the case. During his visit to New, minister of Internal Affairs Roberto Maroni said that the two arrests were related to the operations against the suspected terrorists in Belgium. He also refused to give more details.

Siemens AG and Three Subsidiaries Plead Guilty to Foreign Corrupt Practices Act Violations and Agree to Pay $450 Million in Combined Criminal Fines
Coordinated Enforcement Actions by DOJ, SEC and German Authorities Result in Penalties of $1.6 Billion

WASHINGTON—Siemens Aktiengesellschaft (Siemens AG), a German corporation, and three of its subsidiaries today pleaded guilty to violations of and charges related to the Foreign Corrupt Practices Act (FCPA), the Department of Justice and U.S. Securities and Exchange Commission announced.

At a hearing before U.S. District Judge Richard J. Leon in the District of Columbia, Siemens AG pleaded guilty to a two-count information charging criminal violations of the FCPA’s internal controls and books and records provisions. Siemens S.A.- Argentina (Siemens Argentina) pleaded guilty to a one-count information charging conspiracy to violate the books and records provisions of the FCPA. Siemens Bangladesh Limited (Siemens Bangladesh) and Siemens S.A. - Venezuela (Siemens Venezuela), each pleaded guilty to separate one-count informations charging conspiracy to violate the anti-bribery and books and records provisions of the FCPA. As part of the plea agreements, Siemens AG agreed to pay a $448.5 million fine; and Siemens Argentina, Bangladesh , and Venezuela each agreed to pay a $500,000 fine, for a combined total criminal fine of $450 million.

According to court documents, beginning in the mid-1990s, Siemens AG engaged in systematic efforts to falsify its corporate books and records and knowingly failed to implement and circumvent existing internal controls. As a result of Siemens AG’s knowing failures in and circumvention of internal controls, from the time of its listing on the New York Stock Exchange on March 12, 2001, through approximately 2007, Siemens AG made payments totaling approximately $1.36 billion through various mechanisms. Of this amount, approximately $554.5 million was paid for unknown purposes, including approximately $341 million in direct payments to business consultants for unknown purposes. The remaining $805.5 million of this amount was intended in whole or in part as corrupt payments to foreign officials through the payment mechanisms, which included cash desks and slush funds.

From 2000 to 2002, four Siemens AG subsidiaries—Siemens S.A.S. of France (Siemens France), Siemens Sanayi ve Ticaret A.S. of Turkey (Siemens Turkey), Osram Middle East FZE (Osram Middle East) and Gas Turbine Technologies S.p.A. (GTT)—each wholly owned by Siemens AG or one of its subsidiaries, were awarded 42 contracts with a combined value of more than $80 million with the Ministries of Electricity and Oil of the government of the Republic of Iraq under the United Nations Oil for Food Program. To obtain these contracts, Siemens France, Siemens Turkey, Osram Middle East and GTT paid a total of at least $1,736,076 in kickbacks to the Iraqi government, and they collectively earned more $38 million in profits on those 42 contracts. Siemens France, Siemens Turkey, Osram Middle East and GTT inflated the price of the contracts by approximately 10 percent before submitting them to the United Nations for approval and improperly characterized payments to purported business consultants, part of which were paid as kickbacks to the Iraqi government as “commissions” to the business consultants. For the relevant years, the books and records of Siemens France, Siemens Turkey, Osram Middle East and GTT, including those containing false characterizations of the kickbacks paid to the Iraqi government, were part of the books and records of Siemens AG.

As the charging and plea documents reflect, beginning around September 1998 and continuing until 2007, Siemens Argentina made and caused to be made significant payments to various Argentine officials, both directly and indirectly, in exchange for favorable business treatment in connection with a $1 billion national identity card project. From the date that Siemens AG became listed on the New York Stock Exchange on March 12, 2001, through approximately January 2007, Siemens Argentina made approximately $31,263,000 in corrupt payments to various Argentine officials through purported consultants and other conduit entities, and improperly characterized those corrupt payments in its books and records as legitimate payments for “consulting fees” or “legal fees.” Siemens Argentina’s books and records, including those containing the false characterizations of the corrupt payments, were part of the books and records of Siemens AG.

According to court documents, beginning around November 2001 and continuing until approximately May 2007, Siemens Venezuela admitted it made and caused to be made corrupt payments of at least $18,782,965 to various Venezuelan officials, indirectly through purported business consultants, in exchange for favorable business treatment in connection with two major metropolitan mass transit projects called Metro Valencia and Metro Maracaibo. Some of those payments were made using U.S. bank accounts controlled by the purported business consultants.

In the charging and plea documents, Siemens Bangladesh admitted that from May 2001 to August 2006, it caused corrupt payments of at least $5,319,839 to be made through purported business consultants to various Bangladeshi officials in exchange for favorable treatment during the bidding process on a mobile telephone project. At least one payment to each of these purported consultants was paid from a U.S. bank account.

“Today’s filings make clear that for much of its operations across the globe, bribery was nothing less than standard operating procedure for Siemens. It should be equally clear that Siemens has undertaken significant remedial measures, instituted real reforms and cooperated from the inception of this investigation,” said Acting Assistant Attorney General Matthew Friedrich. “The Department and our international colleagues will continue our efforts to level the business playing field, making it free from corruption and fair to those who seek to participate in it.”

“The coordinated efforts of U.S. and German law enforcement authorities in this case set the standard for multi-national cooperation in the fight against corrupt business practices,” said U.S. Attorney for the District of Columbia Jeffrey A. Taylor. “To its credit, Siemens has taken extraordinary steps to reveal its long-standing, systemic criminal conduct and it has fundamentally restructured its operations to make them transparent and honest going forward.”

“This pattern of bribery by Siemens was unprecedented in scale and geographic reach. The corruption involved more than $1.4 billion in bribes to government officials in Asia , Africa , Europe , the Middle East and the Americas ,” said Linda Chatman Thomsen, Director of the SEC’s Division of Enforcement. “Our success in bringing the company to justice is a testament to the close, coordinated working relationship among the SEC, the U.S. Department of Justice, and other U.S. and international law enforcement, particularly the Office of the Prosecutor General in Munich .”

“Today’s announcement of the guilty pleas entered by Siemens AG and several of its regional companies reflects the FBI’s dedication to enforce the provisions of the Foreign Corrupt Practices Act,” said Joseph Persichini Jr., Assistant Director in Charge of the FBI’s Washington Field Office. “Simply stated, it is a federal crime for U.S. citizens and companies traded on U.S. markets to pay bribes in return for business. The FBI will continue to assist its law enforcement partners to ensure that the corporate and business communities are not tarnished with violations of the kind we are presenting here today.”

“Complicated schemes involving high finance, bribery and corruption, particularly in the international arena, are often solved most efficiently through a multiple-agency approach to crime fighting,” said Eileen Mayer, Chief of Internal Revenue Service (IRS) Criminal Investigation Division. “As the IRS expands its international presence and impact, we are proud to lend our financial investigative expertise to this formidable multi-agency approach that has culminated with today’s guilty pleas.”

The resolution of the U.S. criminal investigation of Siemens AG and its subsidiaries reflects, in large part, the actions of Siemens AG and its audit committee in disclosing potential FCPA violations to the Department after the Munich Public Prosecutor’s Office initiated searches of multiple Siemens AG offices and homes of Siemens AG employees. Siemens AG and its subsidiaries disclosed these violations after initiating an internal FCPA investigation of unprecedented scope; shared the results of that investigation with the Department efficiently and continuously; cooperated extensively and authentically with the Department in its ongoing investigation; took appropriate disciplinary action against individual wrongdoers, including senior management with involvement in or knowledge of the violations; and took remedial action, including the complete restructuring of Siemens AG and the implementation of a sophisticated compliance program and organization.

Under the terms of the plea agreement, Siemens AG agreed to retain an independent compliance monitor for a four-year period to oversee the continued implementation and maintenance of a robust compliance program and to make reports to the company and the Department of Justice. Siemens AG also agreed to continue fully cooperating with the Department in ongoing investigations of corrupt payments by company employees and agents.

Today, Siemens AG also reached a settlement of a related civil complaint filed by the Securities and Exchange Commission (SEC), charging Siemens AG with violating the FCPA’s anti-bribery, books and records, and internal controls provisions in connection with many of its international operations including those discussed in the criminal charges. Siemens AG agreed to pay $350 million in disgorgement of profits relating to those violations.

Also today, Siemens AG agreed to a disposition resolving an ongoing investigation by the Munich Public Prosecutor’s Office of Siemens AG’s operating groups other than the Telecommunications group. The charges were based on corporate failure to supervise its officers and employees, and in connection with those charges Siemens AG agreed to pay €395 million or approximately $569 million, including a €250,000 corporate fine and €394.75 million in disgorgement of profits. In October 2007, in connection with charges related to corrupt payments to foreign officials by Siemens AG’s Telecommunications operating group, the Munich Public Prosecutor’s Office announced a settlement with Siemens AG under which Siemens AG agreed to pay €201 million, or approximately $287 million, including a €1 million fine and €200 million in disgorgement of profits.

In connection with the cases brought by the Department, the SEC and the Munich Public Prosecutor’s Office, Siemens AG will pay a combined total of more than $1.6 billion in fines, penalties and disgorgement of profits, including $800 million to U.S. authorities, making the combined U.S. penalties the largest monetary sanction ever imposed in an FCPA case since the act was passed by Congress in 1977.

The Department and the SEC closely collaborated with the Munich Public Prosecutor’s Office in bringing these cases. The high level of cooperation, including sharing information and evidence, was made possible by the use of mutual legal assistance provisions of the 1997 Organization for Economic Cooperation and Development Convention on Combating Bribery of Foreign Public Officials in International Business Transactions, which entered into force on Feb. 15, 1999 .

The criminal case is being prosecuted by Deputy Chief Mark F. Mendelsohn and Trial Attorney Lori A. Weinstein of the Criminal Division’s Fraud Section, and by Assistant U.S. Attorney John D. Griffith from the U.S. Attorney’s Office for the District of Columbia . The criminal case was investigated by FBI agents who are part of the Washington Field Office’s dedicated FCPA squad. Investigative assistance also was provided by the Internal Revenue Service – Criminal Investigation.

The Department acknowledges and expresses its appreciation of the significant assistance provided by the staff of the SEC during the course of this investigation. The Department also acknowledges the exceptional help provided, in the form of mutual legal assistance, by the authorities of Germany , including in particular by the Munich Public Prosecutor’s Office.
