Yes it is but when judges go against what many here want they call it "judicial activism". Since there is no foul yet the court legally has nothing to rule on. So in this case would you be ok with the judge ruling for Berg? If so can a judge take away your driver's license because you MIGHT speed in the future?

Oh and one follow up. It is not ILLEGAL to run for president. Only hold the office if you are not a natural born citizen or over 35 years of age.
