Was so hoping that Mac would win with the help of the PUMAs. It would have gone a far way to unite the country.

Please don’t take offense if you think I am not using “common sense” I am speaking in purely “hypothetical” sense here. My point is there is a potential Constitutional crisis in the making. I am trying to explore ALL scenarios. For example, assuming you are correct in stating that the electorate voted for a “ticket.” What if the ticket is invalid from the very beginning? Remember, Obama picked Biden to be his running mate. There was no primary process, no roll call of states, just Biden accepting Obama’s offer to be his running mate. If Obama is found not to be eligible to hold the office, how can he pick a running mate? It is very similar to the “fruits of the poisonous tree” concept. If the police perform an illegal search, anything that flows from the illegality is not admissable in a court of law. So, if Obama can’t legally hold the office, how can he legally tap Joe Biden to be his VP?

An election based on the perpetration of a fraud is no election. The remedy is to remove the basis of the fraud (in this case, Obama).
Thus, ALL of his 55+ million votes are thrown out. His electors are disqualified since technically, no one voted for them. McCain’s electors replace Obama’s since he now has the most votes in each state.
McCain’s electors are pledged to him - do you REALLY believe that they would go against that and vote for a different DEM (who, I don’t know - Hillary maybe?). Remember Obama has been disqualifed ...
I’m questioning the Puma thing. And McCain just couldn’t inspire anyone. Palin did but insiders in the campaign undermined her. A campaign insider named Wallace is a friend of Katie Couric. They never had a chance.

The 12th Amendment ratified September 25, 1804.
This removed the flaw in the Constitution (Article II, Section 1, Paragraph 3) where Jefferson (Presidential candidate) and Burr (VP candidate) both tied with the same number of votes. It took the House of Representatives 35 votes to elect Jefferson.
The 12th Amendment provides for the separate election of POTUS and VP.
Biden was not a fraud. He was nominated and elected.

Again, OBAMA picked Biden, affirmed by voice acclamation at the convention, but this occured AFTER OBAMA was the presumptive nominee. If Obama isn’t qualified to hold the office, he isn’t qualified be the nominee and he isn’t qualified to nominate Biden.
As a former cop and a student of the law, I’m more interested in the abstract. That;s why I was asking for someone with Constitutional law experience to try and sort this one out. As an exercise in law, this could have ramifications beyond this election.

I’m certainly tired of trolls. The new signups have driven me nuts tonight. You can tell the trolls as logic is beyond them. You can debate a FReeper.(Talking to 2 real ones now) A lib talks in circles. I quoted ones posts back to them and they said I must have a dysfunctional family. It made no sense.
