There’s no rule that ‘9’ is the number of justices that should be the Supreme Court. Obama is not limited to replacing justices ... he can appoint 10 more justices and bump the number up to 19.
Someone else mentioned this the other night. They said FDR had “tried it”. Has there ever been a time on the court where there are more than nine?
