Clearly this turn of events is further proof that berg’s case has no merit. /sarcasm Or /ostrich mode

Every case filed with the Supreme Court is scheduled for a confrence. It doesn't mean the Justices actually discuss it-- before each conference, each Justice prepares a memo listing the cases he or thinks are worth discussing. Unless at least one Justice puts the case on their list, it is not discussed at all, and a memo issues the following Monday saying that certioarari is denied.

If you had read the actual post, you would see that your statement is bogus. From the posted article you can see that the admission for conference was DENIED by both Kennedy and Souter prior to being admitted by Scalia. This is evidence that not EVERY case is scheduled for a conference....
