If you are slight of build, or not a regular drinker, beware.

I was in a jury pool once where the judge said “you don’t need to be over the limit to be guilty”. I never drive after even one drink.

Regular drinker has virtually no effect on BAC. As a former defense attorney I worked directly with DUI charges in over 1000 cases. With 2 glasses of wine (in 1 hour) I would NOT take the chance. Or with 2 beers (in 1 hour). Or with one ‘stiff’ bar drink in 1 hour. We here in AZ boast? the most stringent DUI laws in the country due mainly to a very active MADD group.

In my dealings with these idiots, I have found them to be even more radical than the tree-hugging faction by far. Totally irrational and out for blood. Most claim (often falsely) that they ‘had a daughter/son killed by a drunk’. In many cases the drunk was the kid driving their car who was as drunk as the family member killed. In some cases the drunk got drunk at the MADD mother's home and sometimes with their knowledge.

It seems that they are on a guilt trip and trying their damndest to transfer that to others.

I have had clients who were drunk but were broadsided by a sober idiot. Of course the fact that the sober kid caused the wreck is of no consequence.

I have serious questions about the current IR5000 breath test machine and if I was to take one, I would demand to see ALL calibration and performance records from both before and after mine.

As to blood testing, that is almost foolproof IF the chain of custody is clean. Very Happy New Year, everyone.

The "legal" limit doesn't matter, sport.

You will be prosecuted and convicted if you attract the attention of the LEO's.

I'm not sure BAC is a good measure of the degree to which one is impaired. I am generally a real lightweight (that does not refer to my build) when it comes to alcohol and I'll rarely have more than one drink if I'm driving because I know that limitation. Heck, I didn't drink at all (or drive) last night - I have to be in the right mood.

Point is, I would get to where I believe I shouldn't be driving at a point where I don't think I'd blow .08

But I don't drink often. Certainly less than once a month and enough to actually get “drunk” maybe once every couple years. 30 years ago that may have been multiplied tenfold, and I was still a more conservative drinker than the crowd I ran with. They are all dead though - it was a rough crowd and they were mostly gone before they hit 40.
