Here we post those things in obvious fun. The HP posted it as truth. The question at the trial will be whether HP killed it immediately when it was found to be fake, or HP found (or knew from the beginning) that it was fake and sat on it as long as they could in order to keep up the smear on Gibson.

Not always. Sometimes a freeper will post some picture or satirical article as a real news item or a real picture and depending on the amount of traffic on the tread, that fake article or fake picture could conceivably remain on the forum indefinitely.
